THAT this House calls upon the Government to submit to the Supreme Court of Canada the following questions for the courts opinion in regards to the secession of Quebec or any province,


1.  Under the Constitution of Canada, can the National Assembly, legislature or government of Quebec effect the secession of Quebec from Canada unilaterally?



2.  Does international law give the National Assembly, legislature or government of Quebec the right to effect the secession of Quebec from Canada unilaterally?  In this regard, is there a right to self‑determination under international law that would give the National Assembly, legislature or government of Quebec the right to effect the secession of Quebec from Canada unilaterally?



3.  In the event of a conflict between domestic and international law on the right of the National Assembly, legislature or government of Quebec to effect the secession of Quebec from Canada unilaterally, which would take precedence in Canada?


Mr. Speaker,

The announcement that the province of Quebec will hold a referendum on seceding for Canada in the future is a troubling and worrisome development. There are currently no precedents or clear rules on secession from Canada, as it has never been attempted in past. Therefore, I feel that it is incumbent on this government to inquire as to the legality and validity of such an attempt by a provincial government. We can not have the uncertainty of a separation referendum hanging over our collective heads. There must be clear rules and procedures. I hope that this motion will gain support of the majority of this house, if not unanimity.

I believe, Mr Speaker, that the answers to the above questions are to the negative. However, one can never be too sure. Her Majesty's Loyal Opposition shall support this motion.

Mr. Speaker,

I thank the Deputy Leader of the Opposition for his support and comments. However, I am unsure of the answers to these questions and with a referendum looming in Quebec, the best course of action would be to ensure that the rules of secession are set and followed. It is our parties hope that the referendum is defeated, but we can not count on that alone.

In closing, I do wonder about the governments position on this or any other important issue facing Canadians.
