Constitution of the Progressive Conservative Party of Canada/Parti progressiste-conservateur du Canada

I. Executive Authority
1. The Progressive Conservative Constitution shall outline the structure of the Party and guidelines for its smooth running.
2. Final executive authority, other than under this Constitution, shall rest with the Leader of the Progressive Conservative Party (Leader).
2. (a) The Deputy Leader of the Progressive Conservative Party (Deputy Leader) or other member appointed by the Leader shall hold executive authority in any circumstance where the Leader is unavailable.
3. The Leader shall hold authority to appoint Progressive Conservative Members of Parliament as spokesmen for the Party.
3. (a) Such spokesmen shall include the Deputy Leader and Chief Whip.
3. (b) Policy of the Party shall, from time to time, be decided by such spokesmen.
3. [c] The Leader shall hold authority to remove such spokesmen with good cause.
3. (d) The Leader shall hold authority to define the roles of such spokesmen.

II. Membership in the Party
1. Members of Parliament shall be permitted the Progressive Conservative whip if they have fought an election as a candidate explicitly endorsed and supported by the relevant riding association and/or with the agreement of the Leader, Deputy Leader and Chairman.
2. Members who leave the Party, for whatever reason, shall only be readmitted if supported by a majority of Members in a secret vote conducted by the Progressive Conservative Executive Committee.
2. (a) A vote shall not be required if they have been a Party Candidate in a Parliamentary election immediately preceding their application.

III. Selection of the Leader
1. In the event of the leadership election the Progressive Conservative Executive Committee shall be given full authority to conduct the election.
1. (a) Such powers shall include the timescale of the leadership election.
2. The Leader shall be chosen by the traditional convention system as handled in previous Leadership Elections.
3. The names of Members shall be placed on the ballot paper as a candidate for Leader pursuant to being nominated by fellow Members.
3. (a) In order to be considered nominated, a Member of Parliament must have his or her name nominated by a fellow Member, and seconded by one other Member.
3. (b) Members may submit their own names, and a Member who has been nominated may not second or third the nomination of another Member.
4. The candidate who receives an overall majority of delegates vote for them at the Leadership Convention shall be declared duly elected as Leader.
5. A candidate may withdraw his or her nomination at any point other than during an active voting process.

IV. Discipline and Removal of Members
1. The Leader and Chief Whip shall have sole authority to decide what disciplinary measures shall or shall not be taken against Members for matters relating to Parliament.
2. The Leader and Progressive Conservative Executive Committee shall have sole authority to decide what disciplinary measures shall or shall not be taken against Members for matters not relating to Parliament.
3. The Leader shall have sole authority to decide what disciplinary measures shall or shall not be taken against the Chief Whip for matters relating to Parliament.
4. Members shall only be expelled from the Party and cease to be Members with the consent of the Leader and Chief Whip.
5. If the Leader/Chief Whip/Progressive Conservative Executive Committee wish to expel a Member, then a vote of the caucus must be had and a simple majority is required to remove said Member.
5. (a) The Leader shall only be removed pursuant to Clause V, below.


V. Removal of the Leader
1. The Leader shall remain the Leader so long as he or she maintains the confidence of the Party.
2. Any Member, supported by two other Members, may request a vote of confidence in the Leader through written letter to the Progressive Conservative Executive Committee.
3. The Leader may request the Progressive Conservative Executive Committee hold a vote of confidence at any time.
4. The Progressive Conservative Executive Committee shall administer any votes of confidence.
5. If the Leader loses the vote of confidence, the Progressive Conservative Executive Committee shall immediately declare the leadership vacant and begin preparations for a leadership selection process.
6. The Progressive Conservative Executive Committee may exercise the right to declare the leadership vacant in the event of prolonged absence, illness or incapacity on the part of the leader. Such a decision shall be taken only after the most detailed consultation with Members of the Party.

VI. Amendments to the Party Constitution
1. This Constitution may be amended, from time to time, by secret ballot vote of Members, at the discretion of the Leader.
2. A Member, with the support of two other Members, may write a letter to the Progressive Conservative Executive Committee asking for an amendment to the constitution based on the provisions of Clause V, s.2(a).
3. The support of more than half of voting Members is required to pass amendments to any Clause of the Constitution.
4. The further support of two thirds will be required for amendments to Clause III or Clause VI.
