No surrender of sovereignty in PH-China joint exploration, says ex-envoy
ABS-CBN News

Posted at May 01 2018 10:23 AM

MANILA - Entering into a joint development with China will not sign away the Philippines' sovereignty in the West Philippine Sea, a former Filipino representative to the Association of Southeast Asian Nations said Tuesday.

Speaking to ANC, former ambassador Wilfrido Villacorta said the Philippines remains the only country that has not entered into a joint development with the Asian economic giant.

"I'm saying that why are we wasting this opportunity? There's no surrender of sovereignty. This is a joint development," he said, citing Malaysia and Vietnam as among the region's largest energy producers because of their joint ventures with China.

The former envoy added that the agreement with China can be carefully crafted and structured so that it would not mention issues sensitive to both parties.

"If we want to play it safe, we can say at the outset, as part of the preamble of the service contract, that this joint development does not encroach or violate our sovereignty over whatever area. There should be no mention of the exclusive economic zone," he said.

Seems that former ambassador Wilfrido Villacorta is providing false information. Let it be known, that during the time of former President GMA, PH entered into an agreement for a joint exploration, wherein China will spend everything and PH will get 20% share, with the condition PH will not buy and patrol SCS. And GMA approved.
And that is why PNoy saw how it was in a total disadv to PH and terminated the agreement.

former ambassador Wilfrido Villacorta is providing false information, fooling the entire Filipinos. Just like Du30 pretending to claim WPS because he does not want blamed for the loss due to his no-brainer attitude. A lawyer that does not know/understand/want to implement the law

Wow pare heaven..! I think this guy is under the influence of an Illegal substance... :lollol:

PH agreeing to any kind of Joint Exploration with China in WPS, Benham Rise or any other PH EEZ territories will be GAME OVER for PH.

They never respected the Philippines Sovereignty since from the start when they occupied Mischief Reef, which clearly is inside PH Mainland EEZ territory, Panatag Shoal, so what makes you so sure that they will honour any kind of agreement??? :headbang:

Beijing’s Cabbage patch Strategy is in full swing NON Stop and everytime the Duterte Govt. is trying to play it’s “Bullsh#tting” strategy without sincerely n seriously UP Arming the AFP’s External Defense Capabilities quietly on the side, they are just wasting their time..

Sooner or later the inevitable may happen.. Peoples Republic of the Philippines CHINA!!!

Duterte: 'Remain meek, humble' to get 'mercy' of China's Xi

Duterte, however, said the Philippines is "not giving up" its rights over the West Philippine Sea.

He said China was even willing to find a solution, such as "offering" the joint exploration and development of the West Philippine Sea.

Duterte said in reference to Xi, "Sabi niya (He said), 'Maybe you'll have a bigger share, tingnan natin (let's see).'"

Full transcript: PCOO

So ngayon ang sitwasyon is nandiyan ang West Philippine Sea. We are not giving up our rights. As a matter of fact, we are still insisting until now to the point that they are now willing... Iyan ang sabi nga ni Xi Jinping eh, “we would always find a solution to any problem”.

They are now offering for a joint exploration and development. Sabi niya, maybe you’ll have a bigger share, tingnan natin.

Ang tao naman basta ganun ang paano mo, you remain meek and humble, eh ‘yung ego niya mag-start to and then it turns to something basic like maaawa rin.

:dunno: What can I say but ...

As long as the agreement would follow the constitution of 60 to 40 sharing in favor of the ph with China as subcontractor....if that would be possible.

It is possible, kunwari.

Pero just like the WPS, para saan daw ag friendship and agreement at exploration if PH will not give way. Kesyo alam ng China na atin ang WPS.

That will be how the PH President will fool the Filipinos. Why? It is because for his benefits from China. His weeks in office has a countdown.

Joint exploration would waive PH rights over West Philippine Sea: Hilbay
ABS-CBN News

Posted at May 26 2018 07:35 PM

MANILA—The Philippines would waive its rights over the West Philippine Sea should it agree to a joint oil and gas exploration with China, former solicitor general Florin Hilbay said Saturday.

"That's rather blatantly unconstitutional. It's against the decision in the Philippines vs. China, which declares that we don't have any overlapping entitlements with China over the West Philippine Sea. Which means that the potential oil and gas, such as Reed Bank, is entirely and exclusively ours," Hilbay told ANC.

Listen to Hilbay. Read China's conditions: China Foreign Ministry

Quote:

The concept of "setting aside dispute and pursuing joint development" has the following four elements: 1. The sovereignty of the territories concerned belongs to China. 2. When conditions are not ripe to bring about a thorough solution to territorial dispute, discussion on the issue of sovereignty may be postponed so that the dispute is set aside. To set aside dispute does not mean giving up sovereignty. It is just to leave the dispute aside for the time being. 3. The territories under dispute may be developed in a joint way. 4. The purpose of joint development is to enhance mutual understanding through cooperation and create conditions for the eventual resolution of territorial ownership.

In China's eyes agreeing to joint development means admitting the area is disputed, therefore China has a claim. In fact the nine-dash line extending China's claims up to the coast of Palawan appeared in the wake of the JMSU agreed between Arroyo, China, and Vietnam. United Nations

Joint exploration with China would 'somehow give up' arbitration ruling: analyst
ABS-CBN News

Posted at May 27 2018 12:09 PM

MANILA - Engaging in a joint oil and gas exploration with China in the West Philippine Sea will "somehow give up" the arbitration ruling that clarifies Manila's sovereign rights over the disputed areas in the sea, a maritime expert said Sunday.

Jay Batongbacal, a professor of maritime affairs and Laws of the sea, explained that the government has yet to address legal issues in areas that will potentially be subjects of the joint exploration deal between the Philippines and China.

"Given that we have the arbitration ruling on our side, it's really hard to think of a way to proceed with this joint development without somehow giving up the arbitration ruling," he told ANC.

What Cayetano missed in justifying South China Sea joint development

Patricia Lourdes Viray (philstar.com) - May 31, 2018 - 12:47pm

MANILA, Philippines — Foreign Affairs Secretary Alan Peter Cayetano cited a 1999 paper in justifying the possible joint development with China in the South China Sea, part of which is the West Philippine Sea.

The paper titled "When will conditions be ripe: Prospects for joint development in the South China Sea" discussed the advantages and disadvantages of joint development zones almost 20 years ago, way back when maritime entitlements were unclear.
