The House of Representatives foreign affairs committee on Tuesday held an executive session on a possible joint exploration deal with China over the South China Sea.

Foreign Affairs Secretary Alan Peter Cayetano attended the House hearing and said he would discuss and entertain during the closed-door session the planned joint exploration deals over the South China Sea, where countries have overlapping maritime claims against China.

“We will answer during the executive session the possibility of joint exploration and development,” Cayetano told lawmakers of the House committee on foreign affairs. ...

“I will assure you, any legal framework will conform with local laws and the Constitution,” Cayetano said.

This better not be a case of "[saying] one thing in public and [doing] another on the ground."

MANILA — The Philippines is working on a legal framework for a commercial deal with Beijing before it lifts a moratorium on energy exploration in the disputed South China Sea, its foreign secretary said Thursday.

Exploration at Recto Bank was suspended in 2014 when the Philippines brought China to a Hague-based arbitration court to clarify maritime entitlements in the vital waterway.

The Permanent Court of Arbitration later recognized the Philippines’ sovereign rights within its 200-nautical mile exclusive economic zone where Recto Bank is located.

The Department of Energy is now focused on allowing oil and gas exploration in “areas that are not disputed,” said Foreign Secretary Alan Peter Cayetano.

even if its legal, the important thing is not to allow chinese oil rig platform in Recto or Malampaya bank because if for whatever reason the chinese decides that their platform will permanently squat in recto or malampaya, what will the philippine govt do about it ? we all know , our govt will do nothing. This scenario is not only possible , it is very likely based on past chinese behavior so its better to be prudent and not risk such as disastrous situation. The most that can be allowed assuming its legal is to allow only chinese financial investment in oil exploration, but a big NO to the use of chinese oil drilling platforms in philippine reefs such as malampaya or recto - those oil rig platforms will only be Trojan horses to intrude deeper into our territory.

When Del Rosario met with the Chinese Embassy charge d’affaires last May 31 over the Amy Douglas intrusion, he conveyed the Philippine government’s concern over reports in Chinese state media about China's planned installation of its most advanced oil rig in the South China Sea next month.

Diplomatic sources said China’s planned oil exploration is related to the JMSU which was not continued after the first phase because of questions of legality, the case is still pending with the Philippine Supreme Court, because the project included areas that were not disputed. Under the Constitution, "exploration, development, and utilization of natural resources shall be under the full control and supervision of the State."

To go around the constitutional prohibition, the government changed the word "exploration" to "seismic survey."

One senior Philippine government official traced China’s interest in Recto Bank to the joint survey that China and the the Philippines signed in September 2004. The official, who spoke to me on condition of anonymity, said:

The truth is, there’s nothing in the Spratlys (or Nansha islands) but coral and endangered beautiful fish. There are no oil resources there.

The resources are in Recto Bank which China started claiming only after the previous administration (of President Gloria Macapagal-Arroyo) entered into a Joint Marine Seismic Undertaking (JMSU) with China in 2004.

there is a map somewhere on google that shows a small area in the south china sea that is outside the 200 mile EEZ of any of the claimants. it includes pagasa island among others. that area is the only area that is not disputed in legal terms(UNCLOS rules) but that would contradict china's 9 dash line. it would be shocking if china has indirectly acknowledged that area as undisputed.
on the other hand, undisputed can also refer to the areas ITLOS awarded to us so in a 'narrow' sense this areas are now undisputed. e.g. malampaya and recto banks

Presumably it could mean also out of the West Philippine Sea/South China Sea, or even atolls/islets over which the Philippines and China don't have competing claims.

As for ITLOS/UNCLOS, Duterte's appeasing moves to China demonstrates he doesn't want to give that past victory ruling any importance in order not to irk China.
