The result of the autopsy on the innocent casualties of this operation will determine the criminal liabilities of the policemen involved in the operation.

It is still a question on whether the shots were pointed directly to the innocent victims or was it a consequence of a crossfire. If it was the latter, regardless of the criminals being contributory to the death of the innocent casualties, still the police would be facing a criminal case of negligence out of an ill-planned operation and things that could have been avoided if proper security was implemented to protect civilians from harms way as this incident was not a random one.

Lilian de Vera was right when said in an interview that we ordinary citizens are no longer safe in our neighborhoods - we get shot at and killed or wounded by either incompetent cops or criminals.

very true...

everytime i see a police checkpoint ahead my heart skips a beat suddenly apprehensive. Instead of feeling safe upon seeing police checkpoints, motorists and commuters get scared, afraid that some trigger happy cop suddenly opens fire on civilians.

Moreso, if the policemen manning the checkpoint bore similar qualities of army personnel executing checkpoint duties in rural far flung areas of the countryside where professional approach with motorists is scanty.

As unfortunate as the loss of innocent life may be, if you start hindering Police or Military Operations because you must split your force in order to keep innocent bystanders from wandering into the crossfire; then you might as well not try to enforce the law.

While all possible effort must be exercised to minimize the death of non-combatants, this should not be done to the detriment of the mission and at the risk of LE or Military personnel's lives.

I d on't know about you, but if I heard gunfire I would never deliberately travel towards the sound. I would be doing all I can to get away from those sounds.

Lucky for you that wou were maybe a kilometer away when you heard the gunfire.

Not so with the abovementioned civilian victims - they were right there when the guns fired.

PNP to follow CA order to arrest 8 in 2008 Parañaque shootout

The Philippine National Police on Monday said it will follow the order of the Court of Appeals to arrest eight policemen linked to a shootout in Parañaque City in 2008.

In a radio interview, PNP spokesman Senior Superintendent Generoso Cerbo Jr. said the PNP "respects" the order of the CA on the matter.

"Ang PNP nirerespeto at susundin ang utos ng Korte sa walong pulis na nabanggit," he said in an interview on dzBB radio.

He said the PNP will also find ways to comply with the appellate court's order.

Earlier, the Court of Appeals ordered the arrest of eight Parañaque policemen linked to the shootout with alleged members of the Waray-waray robbery group.

Fatally caught in the crossfire were vacationing seaman Alfonso de Vera and his seven-year-old daughter Lia.

A report in the Philippine Daily Inquirer cited a June 15 resolution of the CA that said Judge Jaime Guray committed grave abuse of discretion after he junked a resolution of the Department of Justice recommending the filing of multiple murder charges against the eight policemen.

Guray was reported to have junked the resolution for lack of probable cause.

Ordered arrested were:


Chief Inspector Lawrence Cajipe,
Chief Inspector Joel Mendoza,
Inspector Gerardo Balacutan,
Police Officers 3 Jolito Mamanao Jr. and Fernando Rey Gapuz,
Police Officers 2 Eduardo Blanco and Edwin Santos, and
PO1 Josil Rey Lucena.

In a 10-page decision penned by Associate Justice Socorro Inting, the CA's Special Seventh Division denied the petition filed by Mrs. Lilian de Vera seeking the reversal of the order issued by Regional Trial Court of Paranaque City, Branch 260 presiding Judge Jaime Guray which cleared the PNP-SAF members of any criminal liability for the death of her husband Alfonso "Jun" de Vera and her daughter Lia.

The appellate court said there was no showing that the judge committed grave abuse of authority that would warrant the reversal of his judgment.

It agreed that prosecutors failed to show strong evidence to support its claim that the accused PNP-SAF members conspired with the operatives of the Highway Patrol Group (HPG) in perpetrating the crime.

Those cleared in the murder charges are P/Supt. Jonathan Calixto, P/CInsp. Hermogenes Cabe, P/SInsp Abraham Abayari, P/Insp Erikson Roranes, P/Insp Ludivico Cordova, PO1 James Yodong, PO1 Allan apil, PO1 Efren Angcuan, PO1 Lloyd Bulayungan, PO1 Nemesio Gano, PO3 Hagar Torres, PO3 Jericho Otaboy, PO3 Guilbert Lopez, PO3 Felix Base, PO3 Eugene Papatew, PO3 Policarpio Jose, Jr., PO1 Sherwin Maybanting.
