Ombudsman orders suspension of 10 Navy personnel

The Office of the Ombudsman ordered the Armed Forces of the Philippines to immediately implement a six-month preventive suspension against 10 personnel of the Philippine Navy for alleged anomalous disbursement of public funds and the procurement of medical supplies, ABS-CBN News reported Friday.

Ordered suspended without pay were Rear Admiral Constantino Jardiniano, Commander; LCmdr. Manuel Gimena, commanding officer, Headquarters Support Command; Mrs. Victoria Buhia; LTJG Daniel Labrador, Procurement Officer; Ensign Annaleen Magdaraog; Rosemarie Siquinia, Supply Accountable Officer; SKC Edmundo Baluca, MFO Inspector; Lt. Joel Tamayo, Chief, Pre-Audit; SSgt. G.M. Labaguis, Supply PO; and R.N. Guillermo, Supply Officer.

The officers are all assigned at the Naval Education and Training Command (NETC), Naval Station San Miguel in San Antonio, Zambales.

In her 10-page order, Ombudsman Merceditas Gutierrez stated that the conditions required to merit the preventive suspension of respondents have been met.

Reports said the Office of the Ombudsman received a letter signed by Concerned Officers and Men of the NETC Zambales regarding the alleged irregular and anomalous conduct of Jardiniano.

During the calendar year 2005, Gimena received a total of P4,334,052.67 million in cash advances. The liquidation submitted by NETC before the Commission on Audit as of December 2005 had the same figure.

However, in Buhia’s Statement of Liquidation and Balances, she reported that the amount liquidated for the same year was P4,812,439.67 or short of P478,837.

"It also discovered that the documents submitted in support of the liquidation were spurious," said the Ombudsman’s statement.

"The COA and NETC had reported the same amount of cash advances but there was still an unliquidated amount of P512,587.20," the OMB-MOLEO investigation discovered for the Calendar Year 2006.

The Office of the Ombudsman for Military and Law Enforcement Offices (OMB-MOLEO) found in their investigation "that respondents conspired and confederated in making the above-mentioned transactions and liquidations".

The OMB-MOLEO also found out that liquidations of cash advances were supported by spurious official receipts, cash/sales invoices without any supporting documents.

Meanwhile, medical supplies purchased by NETC from Calman Trading, Farmacia Callo, R.T. Franco Pharmacy and F.R. Estrada Pharmacy were not delivered to the Naval Station San Miguel Hospital (NSSM).

NETC again made a purchase from Farmacia Pascasio but it was not delivered to the recipient—the NSSM Dental Dispensary.



----how can we have a modern and effective navy if these dastardly practices continue to happen ?, i bet after the suspension, the above will be silently allowed to assume their posts due to 'lack of evidence' :headbang:

The suspension is preventive. This is meant to remove the respondents from office in order to protect evidence -- that is, to prevent the respondents from destroying evidence that they have control over. They will definitely be allowed to return to office after six months.
