Article VFor the purpose of Article IV, an armed attack on either of the Parties is deemed to include an armed attack on the metropolitan territory of either of the Parties, or on the island territories under its jurisdiction in the Pacific or on its armed forces, public vessels or aircraft in the Pacific.

I think its clear that its not only concentrated to armed forces but t o public vessels or aircraft that has Philippine flag on it. Question is, yung banca ba ng mangingisda is a public vessel? lols. Or is west philippine sea is considered part of pacific?

Enrile warns China vs showing Aggression toward Philippines
06-13-2011

Quote:

Senate President Juan Ponce Enrile on Monday warned China against showing aggression toward the Philippines amid the worsening dispute of claimant countries over the Spratlys Islands.

"I would caution China in using or showing any sign of aggressiveness against the country," said Enrile on Monday. "If they will show they are using their very strong military capability to undermine the interest of a friendly neighbor, the world will raise their eyebrows."

He said the Philippines can invoke the RP-US Mutual Defense Treaty in case of a foreign attack.

"Any attack against the forces of either the US or the Philippines in the treaty area will mean an attack against the party to the Mutual Defense Treaty. So we can invoke the MDT," he said. [Click here for a list of the recent incidents in the territorial disputes.]

He explained that President Benigno Aquino III, as commander-in-chief, can invoke the MDT as an executive function. He noted, however, that it still depends on the United States whether it will involve itself in the issue.

But aside from the MDT, Enrile said the country can also invoke the Law of the Sea Convention or the Law of the Sea treaty to the United Nations if China violates the Exclusive Economic Zone (EEZ) of the Philippines.

"If they’re going to explore, if they are going to exploit, if they are going to gather any valuable materials in the area, harvest this in the area, then we can invoke [that]," he said.

The Senate president admitted, however, that the dispute over Spratlys probably will go on for a very long time, unless all claimant countries agree to let the International Court of Justice settle the matter.

"Eventually it has to be resolved somewhere. [But] only if they agree, the other parties," he said. - Kimberly Jane Tan/KBK, GMA News

SPY BITS By Babe Romualdez (The Philippine Star) Updated June 14, 2011 12:00 AM

DFA Secretary Albert del Rosario will be proceeding to Washington, DC sometime soon to ostensibly meet with US State Secretary Hillary Clinton and discuss issues of “mutual concern.” I guess the issue of mutual concern would be the current dispute over the Spratlys which could turn into something more serious, and how this will affect the balance of power in the region. The dispute over the oil-rich territory could prove to be a flashpoint whose impact could have global repercussions on the economy considering the area’s importance as a trade route, with almost one-fourth of the world’s shipping trade traversing the area each year.

Del Rosario, who has called on everyone to follow “the rule of law” regarding the Spratlys to advance a peaceful resolution to the issue - will probably push for an earlier Washington visit of President Noynoy Aquino before the APEC Leaders Summit in Honolulu this November. While Malacañang is confident that the US would take the side of the Philippines on account of the Mutual Defense Treaty between our two countries in case the issue gets worse, it’s unlikely that America will engage in a shooting war against China. US military presence however is being pushed by some quarters.

US Ambassador Harry Thomas sent Spy Bits a text message, clarifying that “...when I said the US does not take sides in regional territorial disputes, I was talking about dispute over boundaries - an issue separate from what the US would do in the hypothetical event of a conflict. As we have repeatedly said, these issues need to be resolved peacefully within the framework of international law.” Interpretation: If China insists on controlling the area which clearly belongs to the Philippines, the US will act accordingly.

Joey Salceda’s economic sanction

A number of Filipino-Chinese businessmen are giggling at the call of Albay Governor Joey Salceda to boycott all products made in China, seeing it as a mere “childish” reaction to a very serious issue. In the first place, the “ordinary Filipinos” whom he is rallying for the boycott can hardly afford to buy anything but cheap Chinese-made products. Obviously, they are much cheaper (some say due to rampant smuggling) compared with Philippine-made products. The fact is almost everything in the world is now made in China, and any call for boycott will hardly make a dent as Joey himself has admitted.

Instead of acting like a petulant child, the country should think of more serious and prudent solutions to the territorial dispute in the West Philippine Sea, the Filipino-Chinese businessmen observed. And as so correctly pointed out by many, the Philippines should learn to stand its own ground without having to rely on its allies to bail it out whenever it finds itself in a tight squeeze. It was once said that if the 1.2 billion Chinese all took a pee at the same time, the Philippines will drown. Now that could be a good argument against the RH bill.

Penny pinchers

For paying a $25 dental bill with pennies, a man has been fined $140 for disorderly conduct. Apparently, the 38-year-old man from Utah disputed the bill insisting he did not owe it - then dumped 2,500 pennies on the counter and demanded that the staff count it. It seems a growing number of Americans are joining the ranks of so-called “penny protesters” who show their disdain for business establishments by literally paying with small change.

A couple of years ago, residents with the encouragement of local politicians in a small New Hampshire borough protested a toll hike by paying in one centavo coins - but the protest fizzled out after irate motorists caught in a traffic jam lodged their own protests. The penny protesters then took to driving slowly towards the toll ramps to halt the traffic - resulting in the arrest of some for traffic obstruction. In another case, several students were put in detention after paying for their lunches using pennies in what could have been a protest or a prank. However, they were pardoned after parents complained - with school authorities explaining that their behavior slowed down the lunch line.

In the Philippines, people are encouraged to save up their small change in tin cans, in particular 25 centavo coins, to start them with small businesses. Apparently the drive became very successful because after a while, government began worrying about a coin shortage because people were holding on to their coin cans far longer than necessary. And in typical fashion, some Filipinos have also begun using coins to pay their bills - particularly to people and establishments they want to annoy.

China says will not use force in West Philippine Sea

BEIJING—China said Tuesday it would not resort to the use of force in the tense West Philippine Sea (South China Sea), after its neighbors expressed concern about its more assertive maritime posture.
“We will not resort to the use of force or the threat of force,” foreign ministry spokesman Hong Lei told reporters.
“We hope relevant countries will do more for peace and stability in the region,” Hong said.
Vietnam on Monday staged live-fire exercises following recent confrontations at sea with China which reignited a long-standing dispute over the sovereignty of two potentially oil-rich archipelagos, the Paracels and Spratlys.

what do you mean useless? Do you think China will decide to mellow down if not for the reactions of Countries involved and the US mingling (mixing themselves in the picture FS) on the issue and particularly for us having the MDT...
