The baseline law is vague on the part of controlling the Spratlys. It discribed it as a regime of islands under the control of the Philippines, which is open to confusion and paving way to who are the powerful that can control it. It is a sign of reservation of fear of China because it ran short of defined sovereign control. However, when a sovereign state declares control over a certain place or territory under it's baseline laws, it can defend any intrusion to assert it's right over the territory. |

yes, Malacañang is up to the challenge of China on the diplomatic and legal front but it seems like the "brainy people" inside the Palace have ignored the military aspect of asserting Philippine sovereignty over the Kalayaan Island Group (KIG) and Scarborough Shoal (and certain parts of Macclesfield Bank). with an air force that completely lacks credible air defense capabilities and a navy that is more of a floating World War II museum, is the Armed Forces of the Philippines really capable of exercising and protecting Philippine sovereignty over the KIG and Scarborough Shoal given the latest pronouncement from Malacañang? shouldn't this latest announcement by administration officials be more than enough reason to finally invest on our country external defenses, especially now that China is more than aggressive in enforcing its claim on the entire South China Sea region, as clearly exemplified by how some PLAN vessels and Chinese "trawlers" harassed the USNS Impeccable on international waters near Hainan Island? |

A battleground in diplomacy and legal play. I dont think China is going to win by using its military. |

Modernization should prioritize: Patrol Ships with air/sub/ship detection, fast & lightly armed for Navy. Surface Attack Aircraft with anti ship/sub attack capability for Airforce. SAM with Radars, Close AA battery capable of shooting ground targets too for Army. This triangle defense will work together and protect us from external threats. | |

I think we have the right to claim the Spratlys coz we are the ones who 1st set foot on those islets as early as 1950s by Tomas Cloma. Chinese historical claims are baseless and its not recognize even in the UN. As far as I remember, Chinese Politburo have decree into law that the whole SouthChina Sea is part of their territory...Thats its a chinese-owned passage waterway and all ships travelling thru will ask the Chinese permission which is Stupid. What if China will come up with a map of Palawan dated back 12th century when their Merchants and Fishermen used to sell their merchandise and stay here for good. Is it fair to us that also claim Palawan as well? I think its about time that we should strenghten our naval and air military defense. Acquiring some ships and F18 jets for air superiority role or a good Mach1,2 Multirole jet like BaE Hawks/ KAI A50/ Yak130 or M346 as lightweight tactical fighter. |

China had immediately criticized Arroyo's claim. The law signed Tuesday defines the territorial baseline encompassing the Philippine archipelago's more than 7,100 islands. Vietnam's foreign ministry said Friday Vietnam has sufficient legal and historical basis for its ownership of the Spratly islands and the Scarborough Shoal. It says Manila's action was a serious breach of Vietnam's sovereignty. Taiwan, Brunei and Malaysia also claim all or parts of the Spratlys. China, Taiwan, Vietnam and the Philippines also claim the Scarborough Shoal. |

MOFA protests Philippines act to annex Spratly islands The China Post Updated Saturday, March 14, 2009 9:36 am TWN, CNA TAIPEI, Taiwan -- The Ministry of Foreign Affairs (MOFA) lodged a protest with the government of the Philippines Friday, reiterating Taiwan's sovereignty over islands and reefs in the South China Sea, including the Spratlys. The ministry summoned the representative of the Southeast Asian country to Taiwan to issue the protest. The MOFA protest came in response to an act signed by Philippines President Gloria Macapagal-Arroyo March 10 to annex some islets and reefs of the Spratly Islands and Macclesfield Bank Islands as part of the Philippines' territory. The Foreign Ministry called on the Philippines to negotiate with Taiwan on the South China Sea sovereignty dispute under the principles and in the spirit of the United Nations Charter, the U.N. Convention on the Law of Sea and the Declaration on the Conduct of Parties in the South China Sea to resolve the conflicting claims peacefully. The Spratlys consist of about 180 barren islets, reefs and atolls in the South China Sea. Vietnam, China, Taiwan, the Philippines, Malaysia and Brunei each claim all or part of the low-lying islands, believed to be sitting on large oil and natural gas reserves. At present, Taiwan has effective jurisdiction over the Spratlys' Dongsha Islands and Taiping Island. |

The U.N. must do a dialogue and decide who owns who, it will be the only solution. China and Vietnam would think twice now using Military option against the Philippines because of their imperial ambitions. |
