China's War on Maritime Law
China is using language to quietly redefine international maritime law.

By James R. Holmes
September 04, 2014

Never surrender to China in the battle of language, Washington. Ceding control of the words we use can be fatal to diplomacy. If you let someone define the words used in an argument how he pleases, or if you let him use terms so imprecisely that they lose all meaning, you let him establish the assumptions from which the argument proceeds. And once he sets the assumptions, he can prove whatever he wants. You will lose every time.

Language, then, is a battleground.

But when a major power pushes extralegal claims and puts steel behind them, it's time for fellow seafaring states to mount a more vocal, more forceful defense of freedom of the seas. Otherwise the principle could decay over time.

US slams Beijing’s wholesale reclamation
By Pia Lee-Brago (The Philippine Star) | Updated October 2, 2014 - 12:00am

MANILA, Philippines - The United States has slammed the “wholesale reclamation” being undertaken by Beijing in the South China Sea, saying it is the “source of clear anxiety and instability” in the contested region.

In a press conference at the New York Foreign Press Center on Sept. 26, Assistant Secretary of State for East Asian and Pacific Affairs Daniel Russel said the US talked to China about the importance of behavior, whether it has to do with the movement of military ships or with the promulgation of unilateral rules that purport to exercise authority over what is regarded by others as contested area or international space.

“We have spoken and continue to speak directly to each of the claimants, particularly the Chinese, about our concerns over reclamation work. That means digging up the bottom of the sea, creating landfill to build out what are essentially rocks or shoals into a large enough territory to hold facilities of various types,” Russel said.

Exclusive: China warns U.S. surveillance plane
By Jim Sciutto, Chief National Security Correspondent - CNN
May 21, 2015

Above the South China Sea (CNN) - The Chinese navy issued warnings eight times as a U.S. surveillance plane on Wednesday swooped over islands that Beijing is using to extend its zone of influence.

This is the first time the Pentagon has declassified video of China's building activity and audio of Chinese challenges of a U.S. aircraft. The aircraft flew at 15,000 feet in the air at its lowest point, but the U.S. is considering flying such surveillance missions even closer over the islands, as well as sailing U.S. warships within miles of them, as part of the new, more robust U.S. military posture in the area.

The Chinese navy ordered the P8 out of the airspace eight times on this mission alone. Each time, the American pilots told them calmly and uniformly that the P8 was flying through international airspace.

That answer sometimes frustrated the Chinese radio operator on the other end.

Just saw the video of the Chinese warning and ordering the P8 Poseidon to leave. The nerve of these people. For those who have not seen it yet better watch cnn more often or at the very least within the next few hours as it sure they replay that footage a few times. The P8 was warned and ordered to leave at least 8x. The commander of the P8 was asked by the cnn reporter if what he thinks of what they saw. And he right away said that it looks like military infrasructures.

With how aggressive the Chinese tried to deter the P8 the more im convinced that the super tucano or any turboprop will not do in the WPS. Too risky.

U.S. Navy flies P-8A Poseidon over new islands in South China Sea

OVER THE SOUTH CHINA SEA (May 20, 2015) Sailors assigned to Patrol Squadron (VP) 45 conduct flight operations aboard a P-8A Poseidon over the South China Sea. During the flight, the crew of the P-8A documented several warnings, issued by China’s People's Liberation Army Navy (PLAN), to leave the area. The mission documented the continued expansion of reefs which have been turned into man-made islands with airport infrastructure in the South China Sea. VP-45 is on deployment supporting U.S. 7th Fleet operations in the Pacific. (U.S. Navy video/Released)

** Check out the surveillance monitor shown at 0:45 - amazing imagery.

I would rather invest the budget for the ST's into additional FA-50's ASAP!

While the father of the 7th fleet USS GW gone for refit/ refurb, USS RR coming after in 4 months time, anything can happen.. :dunno:
I bet the US will be forced to deploy a squadron of US fighter jets in ABAB Palawan to protect it's assets to be deployed in WPS.

These series of provocative illegal control of areas in WPS by China, can quickly turn into an unfortunate events, a bloody showdown between US and China, especially if China tries to continuously humiliate the US and decides to challenge the USN by sending their PLAAF Fighters in the days to come...

If this gets worse, PH is on the losing end.. China could easily target PH controlled areas in KIG and mainland Palawan or Luzon, where ever US FOB, assets are located in the Philippines.
We don't have anything to protect the Country.. :dunno:
"Kapag nagkataon" thanks Aquino Govt. and useless Politikos for the very least prioritized AFPM budget, for the cancelled Maestrale ships from Italy, the very long evaluations and bidding process etc., not to mention cancellations, delays and the lack of priority on more importantly needed acquisitions of Military equipments and weapons for external defense.

Now that China is directly challenging the US Armed Forces, "Ano Sec. Gazmin, do you still believe that China won't go to war over a few rocks in WPS????"

After watching this video, i just feel sorry for ou country, weve been a republic for many years, the Asia's first republic, and still we need the aid of friendly countries to watch our borders. The corruption is too much already that defense have been neglected already. We must always remember, that the defense of our country is the primary resposibility for all of us, but mostly of our government. I think, for a real change to happen, we need someone with new perspective and ideas for the defense, for the leadership. We dont need carefree type people who is now in charge of our country defense. No foresight for any eventualities to happen. You cannot just say they will not go to war for just rocks in the sea, what if they will go to war for it, have you ever prepared for that. I think Pnoy and Gazmin, may have made changes but its very minmal to the effect. Stil our politicians, dont seem to have the grasp of the situation in WPS, in my opinion we can do much more to improve our defense, but we need a difference kind of people. Other countries are much poorer on us, but wy they have a god defense posture. This commies in the congress mus be removed, i dont know, they maybe not working for our country anymore, remember, marxist ideas dont recognize countries at all. Yes they can raise the AFP budget, speed up the process but it should have been done many years ago. We dont want to happen another bataan type of defeat, once is enough already, i think w Filipinos in particlar, dont learn from our History.

Yes you are correct, it's not minimal but it had a HUGE effect, they are responsible for giving China the go signal, to pass the test if the Philippines would blink during the "Scarborough stand off" and we did, courtesy of PNoy.

FYI, regardless of our PN's capabilities, during the time of FVR, Erap even GMA, the SOP in securing and protecting Panatag Shoal and other nearby areas is by using the PF-11 Rajah Humabon, PN's way of discouraging chinese poachers or any kind of intrusions was through firing warning shots on any of them, before even they can enter PH area of responsibility.

IMO, the white ship strategy approach by China could have been irrelevant inside PH territories, waters etc. if PH maintained it's previous normal SOPs, rights upholding it's sovereignty to secure and protect them at all cost, which all clearly falls under the NORM practice of the World under UNCLOS.

Meaning, Chinese White ships, poachers, PLAN etc. intruding inside PH 200 mile EEZ, territories, disregarding warnings and will be considered as threats, can be dealt with the full force of PH Military.

I take my hat off to the Indonesian Armed Forces, :salute: THAT'S THE WAY TO DO IT! :warship: :urock: THE REAL "Tuwid o tama na daan against China creeping invasion or any kind of intrusion, illegal activities etc.!

Panatag Shoal is a REDLINE, a line that shouldn't be crossed, same as the walls of your property, the house where you live in.. but what happens if you let someone cross? or intrude?
It means any of the other REDLINES are meant to be crossed.

I don't know really how this present Govt. thinks, either they are that st_pid and they are not really on PH side or they are dumb not to think that the always best way is to use the opportunity on our privilege of having an MDT with the US, we are the only 3rd World Country in SE Asia that has an MDT w/ the US, puts us along side other super powers the UK, Canada, Japan etc. it's the only reason why our outnumbered PH Marines deployed in KIG are kept safe and untouchable up to this day.

Now that China has up the ante, to challenge US Armed Forces in Asia Pacific, particularly in WPS, directly for the first time, in technically, international waters, areas, airspace in Spartly Islands, once any kind of Naval skirmish starts, the first ones to be runover and sacrificed by the PLA Military will be those PH controlled Areas, our helpless PH Marines and their families, the Kalayaan Filipino Community in general.
"Aanohin pa ang damo, kung patay na ang mga kabayo?"

All because of super relax attitude on China's creeping invasion, "saan ka makaka kita ng pinasok na ang bakuran mo at ninanakaw na ang mga teritoryo mo, pero naka ngiti ka pa at walang ginagawa na paghahanda o paraan para matigil ang crimen???"
