Although the scene was appallingly a pity for the police who were mobbed for doing their job to protect the implementation of a court order for demolition, it has been offset by the beating of an arrested participant of the mob who is unarmed and whose action of slight resistance if any, did not in anyway or the other endangered the lives and limbs of the policemen to justify the use of force and violence.

The evidence is clear and that the video footage cannot lie. Defence of the police when comes a time when there is prosecution of their acts, is nowhere in existence and even the dumbest prosecutor can gain conviction. The unruly crowd should be charged for the acts of preventing the execution of a lawful court order and assault against the police mob control. Almost all of them should be arrested but seems to me the operation is not up for grabs. There was no support or back-up contingency for the front line platoon to effect the arrest of all those who participated the violence. The PNP at this stage showed it's flawed crowd control and again a mismanaged operation.

'Tortured' security guard mistaken for rebel sues police, military

Rolly Panesa, together with his counsels from the National Union of People's Lawyers (NUPL) and Karapatan, filed complaints for unlawful arrest, incriminatory machination, perjury, and for violation of the Anti-Torture Act of 2009 against members of the Philippine National Police and the Armed Forces of the Philippines allegedly involved in his supposed detention and torture in October 2012.

"I will not just accept what had happened to me. I am fighting back to get justice for me and for innocent people who were tortured and jailed," said Panesa.

Named respondents in Panesa's complaint for violation of the Anti-Torture Law, and for unlawful arrest were:

Maj. Gen. Alan Luga, former Commanding Officer (CO) of Southern Luzon Command of AFP,
Maj. Gen. Eduardo Del Rosario, CO of the 2nd Infantry Division of the Philippine Army,
P/Csupt. James Andres B. Melad, former Regional Director of the Philippine National Police Regional Office IV,
P/SSUPT. Manuel M. Abu, Chief of Regional Intelligence Office of PNP Regional Office IV,
P/CINSP. Reynaldo Mendoza of the Regional Intelligence Office of PNP Regional Office IV,
P/Ins. Bonifacio L. Guevarra,
SPO1 Christopher E. Flores,
PO2 Ariel dela Cruz,
PO2 Joseph M. Fernandez, and
POI Ellior de Lima.



Meanwhile, charged with perjury were Col. Generoso Bolina, spokesperson of Southern Luzon Command; Luis Grajo Rayos, Micheal Rojo Alvarado and Erwin Rosales, all rebel returnees.

Mistaken identity

Panesa had insisted his arrest was a case of "mistaken identity" and belied authorities' allegation he was Ka Danilo Benjamin Mendoza, a wanted official of the Communist Party of the Philippines in the Southern Tagalog Region, with a P5.6-million bounty on his head.

The Panesa family, in a petition for a writ of habeas corpus initially filed with the Supreme Court and transferred to the Court of Appeals, said Rolly is 48 years old while the Benjamin Mendoza whom authorities are looking for is 61 years old.

His family also said Rolly is not a rebel but a security guard working for the Megaforce Security Agency.



Arrest

Panesa, his wife Chioco, his stepdaughter and her husband were forced into a van on the night of October 5, 2012, in a barangay in Project 4, Quezon City.

In their petition, Chioco said she and her family were brought to a place that turned out to be Camp Vicente Lim in Laguna, specifically the regional intelligence office of the regional police office in Southern Tagalog.

Chioco claimed they were tortured and interrogated for three hours by the men who took them.

The men also kept on insisting that she was a certain "Ka Luisa" and that her husband was "Ka Benjamin Mendoza," which the Panesa couple repeatedly denied.

Chioco claimed jail officials initially refused to take her husband in without undergoing a medical examination. She said jail officials noted Rolly's injuries when he was brought to the Security Intensive Care Area of the jail facility.



AFP ready face court

"We are confident that we can answer his accusations. In the first place, he was never in our custody. Kasi joint operations ito ng PNP and AFP. [Police] ang nag-serve ng warrant... support lang ng Army. Noong inaresto siya, dinala siya agad ng Camp Vicente Lim. How come ina-accuse niya ang AFP? He was never brought to any AFP camp.... He was never interrogated by the AFP. PNP ang may custody sa kanya," Cabangbang told GMA News Online in a phone interview.

LAGUNA -- The provincial director of the Laguna police and the head of the police provincial intelligence branch have been relieved from their posts following allegations of torture and maltreatment of 15 detainees.

Ordered relieved were provincial director Senior Supt. Pascual Munoz Jr. and PIB chief Supt. Kirby John Kraft.

Chief Supt Jesus Gatchalian, Calabarzon regional police director, said the two police officers were removed effective 3 p.m. Monday for their lapses.

If the motive of the cops involved in the alleged torture was to extract information from the detainee in relation to a case they believed the detainees or some of them might have knowledge or involve with, it clearly showed their incompetence in the area of investigation not to mention gross ignorance of the law, and if it was just a plain cruelty to the detainees due to the influence of liquor, they are plain idiots. They deserve prison more than the detainee and it is a big surprise for any taxpayer to see these cops/law enforces to be still on the job. As one foreigner who happens to be my friend whose wife is a Filipina said, that there are more crooks in the police than in the civilian population. What a shame !

Incidents of this nature is a culmination and consequence of a flawed recruitment and training. It is by nature that when a hoodlum is recruited to the law enforcement agency, he remains to be a hoodlum that even his character will get worse when he is already clothed with authority. No proper BI conducted and most of the time political backings and "padrinos" play a vital role in the acceptance of applicants. :headbang:
