2 minors on Chinese boat seized in West PH Sea deported
Philippine News Agency
May 14, 2014

PUERTO PRINCESA CITY, Philippines - Two minors, who were among the 11 Chinese fishermen whose boat was intercepted loaded with banned marine species near Hasa-Hasa Shoal in the West Philippines Sea, were deported Tuesday night.

The minors were escorted from Puerto Princesa to Manila by Bureau of Immigration-Palawan alien control officer Ferdinand Tendenilla and consuls Duan Qiang and Wu Yongxin of the Chinese embassy in Manila, and put onboard a China Airlines flight.

Four of the detained Chinese earlier claimed to be minors.

However, a dental examination showed that only two of them were.

Returned Chinese fishermen deny poaching

Two Chinese fishermen released by Philippine authorities have said that sea turtles they were accused of poaching were actually traded from a Vietnamese fishing boat.

"When we got caught by the Philippine police, it's true that there were dozens of sea turtles on our vessel, but we had exchanged them with Vietnamese fishermen for food," said Li Xianghui, one of the two fishermen released by a Philippine court earlier this week because they were found to be minors.

Li, who has just returned to his home in Tanmen, a fishing town in Hainan Province, recalled that they set sail on April 24 and reached the Half Moon Shoal in the South China Sea on April 29, where they met with the Vietnamese fishing boat with more than ten fishermen on board.

"They wanted to barter their turtles with daily supplies, so we gave them a bag of rice, four boxes of instant noodles, six cartons of beer, and some drinking water in exchange," Li told Xinhua.

He said they usually encounter Vietnamese or Philippine fishermen catching sea turtles, who ask to exchange the creatures with Chinese fishermen for living supplies. They give the turtles to relevant authorities back home.

Philippine media reported that more than 500 sea turtles had been found on the Chinese vessel, and many were dead according to photographs published by Philippine police.

"There were not that many turtles on our vessel, and the turtles were still alive when we were caught because we kept them in water tanks for protection," Li said, adding that they were there to catch profitable ornamental fish.

Fu Xuanchao, secretary of the Qionghai municipal committee of the Communist Party of China, said that China has put sea turtles under national priority protection. Catching, killing or sale of them have been strictly prohibited in local markets.

Let me see if I get this right... This innocent fisherboy is such a good samaritan that they traded: a bag of rice - (which isn't important when you are at sea for a long time), four boxes of instant noodles -(Chinese are fed up with noodles), six cartons of beer - (no problem as he is too young to drink it), and some drinking water - (which is again no problem as they could drink salt-water) in exchange for some turtles poached by the Vietnamese - with the intent to surrender them to the relevant Chinese authorities, who are incorruptible and trustworthy so that they would be eventually set free and not end up in a Chinese restaurant?

Greenpeace and Sea Shepherd - are you listening? Please... Someone give this boy a medal!!!

Damn these Vietnamese poachers.

Sadly, this fisherboy's outstanding morals was ignored by the Filipino authorities.

HARSH TREATMENT

Li said he was still in shock over the attack, even though he was back home.

"On May 6, we saw seven or eight men with balaclavas on a small boat approaching us. They forcibly boarded our boat and fired shots into the air. We thought they were pirates," Li said.

All the 11 Chinese fishermen were put into a four-square-meter cabin, where the temperature exceeded 30 degrees Celsius.

"They switched off the navigation and alarm system. We were so scared," Li recalled.

During a 38-hour sail to Palawan of the Philippines, Li and his fellow fishermen were not given food but only one bottle of water. They were forced to give fingerprints, and hand over all their personal belongings, including televisions, mobile phones, satellite phones, clothes and food supplies.

"We were put in a small cell without beds. Owing to the language barrier, we could not communicate with the Philippine police. They gestured and even threatened us with their guns against our heads," said He Zhuang, who was released with Li.

"They followed us with guns even when we went to pee. Everyone was depressed and all we could do was to encourage each other."

According to He, the Chinese fishermen were taken to court twice, but they can't understand what the judges said or appeal against the case.

"The Half Moon Shoal is a traditional fishing ground for us," Li said, "this is the first time that we encountered Philippine police, who took a fishing boat to pretend they were fishermen."

The Chinese Foreign Ministry last week urged the Philippines to immediately release the fishermen and make rational explanations.

Global Times

1.) Filipino maritime police looking like pirates.

- Filipino authorities should be more mindful of their appearance. The Jack Sparrow look doesn't go too well with the Chinese. Those Vietnamese poachers surely looked like Wall Street businessmen compared to them.
- Balaclavas should be banned and ultra-high SPF rating sun-block should be encouraged instead.
- Alarm and navigation systems shouldn't be switched off so they (Chinese fishermen and fisherboys) can call their brothers in big white ships for help.
- The Jolly Rogers flag isn't your national flag. The skull and crossbones are so yesterday.

2.) Temporary holding/detention facilities should be air-conditioned, furnished lavishly, provided with a buffet, and be equipped with the latest state of the art entertainment systems. I would like to know if asking for lap dancers be too much?

3.) He now wishes he didn't trade that drinking water with those damned Vietnamese poachers.

- Yes, I now know they can't drink salt water. Apologies.
- Yes, perhaps minors should be allowed to drink beer, so they don't have to trade them the next time around.

4.) Filipino authorities should be able to speak Mandarin, Cantonese, and all the myriad of Chinese dialects.

5.) Guns are dangerous. Don't point them if your aren't planning to use it.

6.) Filipino authorities shouldn't be curious as to how the Chinese men are equipped. Madre de Dios! Some men are quite shy as to how they were endowed. You don't need guns to shoot them off. Let them pee in peace.

7.) Please provide the Philippine Maritime Police with proper ships so they wouldn't have to use a fishing boat in their operations.

** I sincerely hope this fisherboy would continue being a good Samaritan despite his "horrific" experience with Filipinos. For crying out loud. This boy is still in shock!! Although not as shocked as I was when I saw those sea turtles.

** I also wish those turtles realize that although they are relatively safe in Philippine waters, the Chinese think it belongs to them. They should come closer to Palawan just to be on the safe side. Turtles know what the 200 mile EEZ means. The Chinese don't.

** Thank you Global Times! I really needed the laugh... I had a really long day at work.

Chinese plead not guilty to Philippine poaching charges
AFP News - 17 minutes ago

Nine Chinese fishermen arrested by Philippine authorities in disputed South China Sea waters pleaded not guilty to all charges against them on Wednesday, the prosecutor said.

The nine were taken in handcuffs to a court on the western island of Palawan, in a case that has further raised tensions over competing claims by the Philippines and China in the sea.

After the brief proceedings, the nine were taken back to a local jail where they are expected to be detained until their next hearing next month.

The charge of taking a protected species relates to hundreds of endangered turtles, many of them dead, that were allegedly found on their boat.
If convicted, they could face up to 20 years in jail.

However other Chinese fishermen who have been caught in similar circumstances in recent years have been quietly deported, avoiding a major diplomatic row.

1) Will they deported?
2) Will they find boyfriends during their "visit" there?
3) Will they do it again?

1. If political will prevail, they will serve sentence in jail but if our government succumbs to Chinese pressure then they will just deport them.
2. Yes, they need more "lotions" I guess.
3. If they serve 20 years in jail I reckon there is a small probability.

The Philippine military admits apprehending Chinese boats in disputed waters remains a challenge. The reason - limited resources.

Hello moderators!

I suggest a merge. Could we have this thread moved to the piracy, poaching, and illegal fishing thread under the Philippine Navy super thread?

Gracias

Philippine trial of Chinese fishermen stalls without interpreter
Reuters - 23 minutes ago

MANILA (Reuters) - A Philippine case against nine Chinese fishermen caught with endangered turtles at a disputed reef was held up on Tuesday due to the lack of an interpreter, which a prosecutor blamed on pressure from China.

The Chinese fishermen's pre-trial hearing has been postponed twice and a planned session on Wednesday may also be called off unless an interpreter is found. A Chinese businessman based in the island of Palawan in the west of the Philippine archipelago, usually volunteers his services as interpreter in court but has begged off this time.

Presidential Communications Secretary Herminio Coloma said provincial prosecutor Allen Rodriguez had told him that Chinese embassy officials did not want to participate in the proceedings.

"They don't want to provide interpreter for the Chinese fishermen," Coloma quoted Rodriguez as saying. "Judge Ambrocio de Luna and I exerted effort to look for interpreter by requesting the Chinese community here in Palawan for assistance. But they don't want to cooperate with us."

The court has asked the foreign ministry in Manila, the capital, for an official interpreter in order to avoid delay.

Lawyers appointed by the court to defend the fishermen say they are also having difficulty getting the Chinese embassy to certify that they can handle the criminal case. Such a sign-off is a necessary step before they can represent the fishermen as indigent litigants.
