MANILA - A legally binding code of conduct in the South China Sea may restrain the Philippines while giving China a "free pass" for past violations, an international law professor said Tuesday.

Southeast Asian nations and China agreed this week to start negotiations on the code of conduct, after Beijing used the last few years to build massive structures on disputed outcrops.

"The scope of the COC is now more limited to preventing escalation of incidents," said Jay Batongbacal, director of the Institute for Maritime Affairs and Law of the Sea at the University of the Philippines.

"Ultimately that's what happens, it restrains us. Of course, it keeps the peace but it is a peace now that is basically dominated by China," he said.

MANILA - The Philippines' refusal to raise its victory over China before an international court could be seen as defaulting on its claim in the South China Sea, a former Cabinet security official said Friday.

Manila needs to "take firm action very soon" on the arbitration ruling, said Roilo Golez, who was national security adviser under the Arroyo government.

"Law is such a complicated issue that sometimes they might say that you have defaulted already on your claim," Golez told ANC's Early Edition.

"You have shown lack of interest. You had all the opportunity but did not use the opportunity so it can be used against us in the end," he said.

"Today, China is the No. 1 economic power and we have to be friends," Duterte told a business gathering in Manila. He had just flown back from the Vietnamese city of Danang where heads of state, including Xi, had gathered for an Asia-Pacific Economic Cooperation summit.

MANILA − The next major, formal negotiations between Manila and Beijing to resolve lingering territorial disputes in the South China Sea will be held early next year, the Philippine ambassador to China said Saturday.

Ambassador Jose Santiago Sta. Romana, on the sidelines of a forum in Manila, said the two sides are hoping that the next bilateral consultative meeting will happen in the first quarter of 2018 somewhere in the Philippines and that arrangements are currently under way.

"Both sides are discussing when to hold the second one, and the original plan was to hold it in December, but there are some scheduling problems," Sta. Romana said, citing that the discussions will still be held at the undersecretary level.

On Monday, a Reuters report, citing a new report posted on a website run by China’s National Marine Data and Information Service, said Beijing has enhanced its military presence in the South China Sea and “reasonably” expanded its islands in the disputed sea.

Not naive, not foolish. But like GMA, he sells WPS to China. Moreso, giving it away.
Or maybe, it is also just because he is a socialist, as he looks at China majestically. Then soon, he will blame others and also blame US, and say "I thought China is a friend".
