Folks, the Indians just provided a template on how to deal with China's cabbage slicing in the West Philippine Sea. The two cowards, the one in Malacanang and the other one at the DFA, should take heed. Have no doubt, the whole Doklam debacle was a clear victory for India.

Doklam standoff resolution: India's greatest diplomatic victory in decades

The Ministry of External Affairs on Monday announced that following a diplomatic breakthrough Indian troops had begun disengaging at the Doklam border site. Later in the day, reports confirmed that the disengagement exercise had been completed, after a nearly two-and-a-half-month standoff, and the Chinese side had decided to withdraw road-construction equipment from the disputed site.

The end of the Doklam standoff heralds quite possibly one of India’s most spectacular diplomatic victories in decades, and like any real victory it does not need shouting from rooftops. From beginning to end, the execution of India’s strategy here has been flawless and has achieved what India always wanted – Status Quo Ante -- and a much-needed counter to China’s salami tactics. The magnitude of the victory is only understood when we realise how crushing a personal defeat for Xi Jinping this actually is.

A failure by the Duterte administration to file a diplomatic protest against China over the presence of its ships in Sandy Cay, a Philippine land territory, will be tantamount to “disloyalty to the republic,” Supreme Court Senior Associate Justice Antonio Carpio said on Thursday.

“We have to be clear, we have to ask them what are you doing? Why are you not protesting formally?” Carpio told the Inquirer.

The senior justice said that failure of the Philippine government to protest China’s actions in Sandy Cay would allow China to “claim later on that we consented” to their occupation of the area.

The Philippines received a rebuke for the first time from its traditional allies - the United States, Australia and Japan - for not pressing its legal victory in its territorial dispute with China in the South China Sea.

In a joint statement issued on Monday in Manila, US Secretary of State Rex Tillerson and Foreign Ministers Julie Bishop of Australia and Taro Kono of Japan expressed serious concerns over “reclamation” and “militarization” in the South China Sea, which were oft-repeated accusations leveled at China.

They called on China and, for the first time, the Philippines to abide by the ruling of the Permanent Court of Arbitration in The Hague that invalidated Beijing’s sweeping claims in the South China Sea and upheld Manila’s sovereign rights to its exclusive economic zone.

The South China Sea and China's "Four Sha" Claim: New Legal Theory, Same Bad Argument

Officials from the Chinese Ministry of Foreign Affairs advanced a new legal theory that would rely upon China’s sovereignty claims over the “Four Sha” island groups in the South China Sea instead of the Nine-Dash Line.

- The Chinese leadership may have realized that the Nine Dash Line has become too much of a diplomatic liability and easy target for foreign criticism in a way that straight baselines around island groups probably will not.

- By adopting language more similar to that found in UNCLOS, China may be betting that it can tamp down criticism, and win potential partners in the region.

- Most intriguingly, China may have concluded that it can better shape the law of the sea by adopting UNCLOS terminology. As a rising, revisionist power, China has an interest in reinterpreting the existing rules to better suit its interests.

MANILA - President Rodrigo Duterte on Tuesday said he would be “frank” with China with regard to the South China Sea dispute when he meets with its leader on the sidelines of the Asia Pacific Economic Cooperation (APEC) Summit in Da Nang, Vietnam this week.

Duterte said he is holding on to Chinese President Xi Jinping’s promise not to build an island on Scarborough Shoal (Panatag Shoal), which is located some 124 nautical miles off Zambales and is within the Philippines' Exclusive Economic Zone (EEZ).

“I’m going to APEC tomorrow and we have the bilaterals… It would be at that time I would be frank with China also,” Duterte said in a speech during the 67th anniversary of the Philippine Marine Corps in Fort Bonifacio, Taguig City.

The dispute over a string of sandbars called Sandy Cay emerged in August and prompted China and the Philippines to consider negotiating some sort of protocol or arrangement to allow both sides to prevent such incidents from spiraling out of control, Lorenzana said.

The rift over the tiny sandbar near the Philippine-occupied Pag-asa Island — internationally known as Thitu Island — in the Spratly archipelago remains unresolved but both sides pledged not to occupy any new territory, he said.
