MANILA - A party-list lawmaker believes the Philippine government can continue bilateral talks with China without having to raise Manila's arbitration case against Beijing before a United Nations tribunal.

Speaking to radio DZMM, Magdalo Rep. Francisco Ashley Acedillo noted that the Philippine Constitution actually spells out what the government should do in terms of foreign policy.

"Our Constitution requires us to be in amity with all nations. That takes care of the policy," he said.

You've been talking to them for 2 decades and all they do is take more of your territory. They're willing to talk now (at least pretending to) because of the arbitration case that you've filed. Drop that and the cycle resumes.

A dialogue is possible if there are no pre-conditions. It always starts there and the success of such dialogue is determined by honour and compromise on both sides. Question is... Have they ever compromised on anything? You lost Scarborough Shoal because you took their word of honour and agreed to leave - they stayed.

Old habits die hard, but in China's case... It never dies.


Mr. bandofbros is right - protection of your territory comes first.
Mr. icefrog is right - you have the moral high ground. That's your only advantage. Use it and press that advantage.

Exactly, humiliating for an ex-soldier.

But remember those Sierra Madre marines that extended their patrol as their replacement was blocked by the Chinese CC?
The PN enlisted the assistance of a US P8 to sort of secure the changing of the guards. And the team that was extracted all were bearded as they lost their shaving tool?

They became instant celebrities and became part of almost all media interviews. I remember one soldier there in an interview with a collapse will, saying that the dispute should be resolved fast and at all cost (non-militarily it seems) because they don't want the experience of guarding Sierra Madre again and they pity for the next batch... or to that effect.

Shameful too in my opinion. Hope not all soldiers and ex-soldiers are as weak as them in defending our territory.

They are promising this now, Hong. For the PH to sit down with them. At least the Chinese ambassador is summoning back the PH side to the bilateral table WITH NO PRE-CONDITIONS.

But as you've emphasized, how much can we trust the Chinese? How truthful are they given that they've broken agreements during the Scarborough stand-off.

Valte said that Professor Philippe Sands closed the First Round of Arguments by summarizing the submissions of the Philippines presented in the course of the hearings.

- The key hurdle is the question of jurisdiction: That is to say, whether the Arbitral Tribunal, formed under the aegis of the UNCLOS, has the mandate to rule on the Philippines’ case against China. We won’t be able to even defend the merit of our case, unless we convince the court that compulsory arbitration is the way forward.

- What is at stake is not only the merits of the Philippines’ arguments, and the questionable character of China’s sweeping claims, but also the very credibility and viability of international law as the primary arbiter for resolving seemingly intractable territorial spats. This is precisely why the whole international community is anxiously following the ongoing proceedings at The Hague. If the Arbitral Tribunal turns down jurisdiction, and refuses to even hear the merits of our arguments, then the very viability of international law as a conflict-management/resolution mechanism will come under question.

- The big concern is that while the legal cycle slowly grinds, China is actually changing the facts on the ground on a daily basis. This is why it is extremely important that the Philippines remains vigilant, and primarily focuses on tangibly guarding its interests on the frontline by fortifying its position on features it already controls, negotiate necessary measures to prevent unwanted clashes and escalation in the high seas, and employ all instruments in its toolkit to protect its territorial integrity.

- An urgent concern, in particular, is to prevent China from imposing an Air Defense Identification Zone (ADIZ) in the Spratly chain of islands. The truth is that, we can’t only rely on UNCLOS to address this critical situation, and we will need the help of our allies and partners across the world as well as the full support of the Filipino nation.

MANILA - The Philippines will face the United Nations (UN) Arbitral Tribunal for a second round of arguments on Monday, July 13.

Deputy presidential spokesperson Abigail Valte said government received word that the Arbitral Tribunal will conduct a second round of arguments on the issue of jurisdiction.

The Philippines has filed an arbitration case before the court in The Hague, Netherlands, against China over territorial disputes in the West Philippine Sea (South China Sea).

"The Philippine side has undertaken sufficient preparation to ensure that the best answers will be provided to the questions expected to be propounded by the Tribunal during the second round," Valte said in a statement.

Today marked the end of the first oral arguments in the Philippines’ arbitration case regarding Chinese actions in the South China Sea. From July 7 -13 ,the Permanent Court of Arbitration in The Hague held a hearing on the question of jurisdiction, a response to China’s claims (expressed obliquely, in a publicly-released position paper) that the arbitral tribunal has no jurisdiction to resolve the case, as it cannot judge on issues of sovereignty. The tribunal expects to make a decision on the issue of jurisdiction by the end of the year. If it dismisses concerns about jurisdiction, the tribunal will only then begin to hear the meat of the Philippines’ argument regarding the validity of China’s nine-dash line and the question of the status of certain maritime features in the South China Sea.

Though this hearing was nominally limited to the question of jurisdiction, statements from the Philippines went beyond that narrow scope to get at the meaning of the case as a whole. As one might expect, Manila and Beijing have opposing views on the purpose and utility of arbitration, and that opposition sets them up for a showdown when the court makes its final decision.

China urges Philippines to ditch its South China Sea case

BEIJING (AP) - China urged the Philippines on Tuesday to ditch its attempt to solve South China Sea territorial disputes with an international tribunal and instead negotiate with Beijing directly, following the arbitration panel's latest request for input from China.

The Philippines praised the tribunal's effort to prod China again to join the case, saying the five-man arbitration body has been fair and transparent in its handling of Manila's complaints against Beijing.

Beijing says fears that it would eventually limit freedom of navigation and overflight to back its claims are unfounded.
