what i am worried here is that if aquino resigns, binay will automatically replace him by law. if that happens there is a possibility that binay might rescind or pull out our case against the bully with ITLOS. is an executive order sufficient to pull out our case ?
if Aquino really has to resign, i hope he does it after the ITLOS ruling . Better still i hope he just hangs on and finish his presidential term(because its bad for political stability) and wait for the court trial against him that is sure to follow just as what happened to his predecessors.

Now I see this post by boxster that an american reporter overheard bully funding to remove aquino:

The absence of a party or failure of a party to defend its case shall not constitute a bar to the proceedings. Under international law it is clear that no amount of dredging or construction will alter or enhance the legal strength of a nation's territorial claims. No matter how much sand you pile on a reef in the South China Sea, you can't manufacture sovereignty. So my question is this: What does China intend to do with these outposts?"

I'm thinking US and PH maybe just waiting for the ruling outcome of UN Tribunal, then the real games will start some time, when the ruling's out.. :dunno:

As diligent Diplomat readers may be aware, the situation in the South China Sea is starting to heat up. The United States has started challenging China’s ongoing land reclamation activity in a bid to demonstrate that despite China’s actions, the sovereignty of the disputed reefs and islands, in the Spratlys and elsewhere, remains indeterminate. The United States’ use of aircraft and soon ships, if recent reports are accurate, is designed to support a particular interpretation of international law and how it applies in the South China Sea.* The United States purports to defend the freedom of navigation in a manner consistent with international law. In this context, the fact that the United States has not ratified the United Nations Convention on the Law of Sea (UNCLOS) is somewhat problematic.

To be sure, despite having never signed UNCLOS, U.S. policy and treatment of the maritime commons understands the U.N. treaty as a pillar of customary international law. This means that the United States behaves as if UNCLOS is the de facto international standard for maritime security. This is a good thing, but it doesn’t help strengthen the United States’ position on freedom of navigation and the much trickier questions of territorial sovereignty against China’s ongoing attempts to change the facts on the water. The current U.S. administration should make it a priority to see UNCLOS ratified before it leaves office in January 2017.

China's Territorial Claim at Risk in the South China Sea

The Permanent Court of Arbitration (PCA) at The Hague has announced that in July it will be holding the first hearing on the 2013 arbitration case the Philippines filed against China
questioning the legal validity of China's '9-dash line' claim over the South China Sea. Since China has refused to participate in any way in the proceedings, Philippine government officials are hopeful that an initial favorable ruling concerning jurisdiction and admissibility of the Philippine case will be the result.

To date, as the arbitral panel has noted, China has not submitted a single responsive paper. The panel is expected to proceed with the case even without China's appearance. This will result to a judgment that will not be binding to China, but it will be binding upon the Philippines. The five-member tribunal is composed of the following judges: Chris Pinto, president (Sri Lanka), Jean-Pierre Cot (France), Stanislaw Pawlak (Poland), Alfred Soons (the Netherlands) and Rüdiger Wolfrum (Germany). Given the composition of the panelists, a ruling in favor of the Philippines is certainly possible.

Philippines to submit 300-year-old map to UN in case vs China

MANILA, Philippines — The Philippine government will be submitting to the United Nations Tribunal on the Law of the Sea in The Hague this week an almost 300-year-old map of the Philippines showing the disputed Scarborough Shoal being part of Philippine territory as far back as three centuries ago.

The Jesuit priest Pedro Murillo Velarde had the map published in Manila in 1734. It surfaced in 2012 among the possessions of a British lord, who put it up for auction at Sotheby’s in London, where Filipino businessman Mel Velarde bid and got it for £170,500 ($266,869.46 or P12,014,463.09).

The first certified true copy of the map has been reserved for Malacañang. Velarde will personally present it to President Aquino on June 12, the anniversary of Philippine independence.

How Velarde, president and chief executive officer of Information Technology-based Now Corporation, acquired the map that had lain among the treasures of one of England's most prominent families for more than 200 years is like something out of the movies.

Velarde said Supreme Court Justice Antonio Carpio, a long time friend, suggested to him sometime in October last year to bid for the Murillo Velarde map. Velarde said Carpio's convincing line was: "You know, man, you're a Velarde."

Carpio, who has been conducting lectures debunking China's claim of almost the entire South China Sea, calls the Murillo Velarde map the "Mother of all Philippine maps."

Local public and private museums declined to take part in the Sotheby's bid. The National Museum was interested but didn't have the money, so the plan was for Velarde to buy the map and sell it later to the National Museum.

The Murillo Velarde map measures 1,120 by 1,200 mm. The Sotheby's catalog carried a description of the map by Filipino historian and biographer Carlos Quirino: "Murillo Velarde's map of the Philippines is a landmark in the depiction of the islands, and the first scientific map of the Philippines. It is flanked by two pasted-on side-panels with twelve engravings, eight depicting native costumed figures, a map of Guajam (Guam) and three city or harbour maps, notably Manila."

Now that Velarde owns the map, the National Museum has informed him it has no funds to buy the map this year, and that there was some uncertainty about funds next year. Velarde decided to donate the map instead.
