Japan backs Philippines' legal move vs. China By Camille Diola (philstar.com) April 1, 2014 - 5:15pm MANILA, Philippines — Japan declared its support for the Philippines' pursuit for arbitration to resolve the dispute with China over outcrops in the South China Sea. In a statement Tuesday, Japan's Ministry of Foreign Affairs backed the Philippines' move despite China's rejection of the case before the UN International Tribunal on the Law of the Sea. "The government of Japan supports the Philippines' use of procedures under the United Nations Convention on the Law of the Sea aiming at peaceful settlement of disputes on the basis of international law," Japanese foreign ministry deputy director Koichi Mizushima said. <snipped> "Such an action contributes to the maintenance and enhancement of the international order in the region based on the rule of law," he said. ‘PH arbitration case vs. China will not succeed’ ANC – April 3, 1979 The Philippines’ arbitration case against China regarding the West Philippine Sea “will not succeed,” a professor of Chinese studies said on Thursday. “It will not succeed because number one, it will take a long time for UNCLOS [United Nations Convention on the Law of the Sea] to make that kind of decision. That is very technical. It is almost outside the legal authority of UNCLOS itself,” Marwin Samuels, Professor Emeritus of Chinese studies in Syracuse University, said. Samuels also says, since the territorial dispute involves legal and technical matters, it will take the arbitration panel a long time to pore over the documents. He made these remarks days after the Philippines lodged an arbitration case at the International Tribunal for the Law of the Sea (ITLOS). “China is not likely to pay too much attention to these legal niceties,” the professor said. China has repeatedly said it will not participate in the arbitration case because it prefers bilateral talks. <snipped> However, China “will not be willing to let a third party decide its territorial boundaries,” Samuels said. But Samuels believes China will not bother to impose trade sanctions on the Philippines, as some had feared. DFA reminds Beijing: You started it all, we're just following international law By: InterAksyon.com April 4, 2014 2:06 PM MANILA – The Philippine government said Friday it won’t detail the contents of the Memorial it submitted to a UN arbitral tribunal on its maritime row with China in compliance with sub judice rules, but stressed—in reply to Beijing’s claim that the filing “seriously damaged bilateral relations” – that it did so purely in adherence to international law. In a statement released by the Department of Foreign Affairs, Secretary Albert del Rosario reminded China – whose foreign minister, embassy in Manila and state media have one after the other excoriated Manila’s submission of the Memorial or summary of arguments to the tribunal in The Hague last March 30 – that the recourse to international law was the only right thing to do given how its sovereignty had been threatened by its giant Asian neighbor. He noted: “The Philippines is not the country that has greatly increased its naval and maritime presence in the South China Sea. Nor has it challenged freedom of navigation. Nor has it blockaded nor forcefully intimidated any other country in the South China Sea.” Despite all these, del Rosariio said “the Philippines makes clear that it will continue to exercise self-restraint and will not raise tension in the South China Sea.
