China offers PH 'carrot' to quit case

MANILA, Philippines – In a last-ditch attempt to derail a historic case, China has offered the Philippines incentives such as the mutual withdrawal of ships from the disputed Panatag (Scarborough) Shoal, sources told Rappler.

China wants to stop the Philippines from submitting its written pleading, called a memorial, to the International Tribunal for the Law of the Sea (ITLOS) by March 30, these sources said.

Asked for comment, the Chinese Embassy said it has “no information to offer” about this.

But former national security adviser Roilo Golez said China is “worried” about the memorial. “In fact, they're even offering a carrot so that we don't submit on the deadline,” he said.

The “carrot,” he said, is the offer to mutually withdraw from the shoal in the contested West Philippine Sea (South China Sea). ...

Through a lawmaker who acted as a backdoor negotiator, China reportedly offered not only the mutual withdrawal from Panatag, but also more investments.

This issue divided the Cabinet. Foreign Secretary Albert del Rosario stood by his position to pursue the case, the source said. ...

Despite this, the Philippines said it is bent on submitting its written pleading. Besides, deputy presidential spokesperson Abigail Valte on Wednesday, February 26, said she has "no information" about incentives offered by Beijing.

In a media briefing on Tuesday, February 25, Department of Foreign Affairs spokesman Raul Hernandez also said the Philippines is “preparing” to submit its memorial by March 30.


The Philippines' lawyer in its case against China, Paul Reichler, said the memorial “will be submitted to the arbitral tribunal on time, that is, on or before March 30, 2014.”

“I am aware of no reason why this would not happen,” Reichler said in an e-mail to Rappler. ...

Deciding not to file the memorial, Golez explained, “might affect us irreversibly.”

“If they withdraw today, they can come back tomorrow. There's no parity in the possible exchange of concessions,” he said.

any official who will support this bully carrot not only has a low IQ , and comprehension of the situation, but also deserves to be shot.
1.) if the bully withdraws, there is absolutely no guarantee they will not come back. they already promised to withdraw before from scaborough but they broke their promise
2.) we will lose the respect of strong allies such as europe, australia, japan and the US who have been standing steadfast in support of us and against the bully.
3.) it will show we do not have a backbone with no principles.
4.) we only accept a carrot if the case is strongly in favor of the bully, but legal experts agree it is strongly in our favor
5.) who knows if sometime in the future the bully will find a way to control UNCLOS and its courts and veto any filing of cases against the bully. Hence, now is the time to file the case. this is the golden opportunity.
6.) The reason the bully is offering the carrot is precisely because their legal position in the case is very weak. In essence, the bully is bribing us to withdraw the case, just like the rich father of a rapist who is offering the
victim, cash money to withdraw her case against his son.

...... or to put it in Congressman Golez' words,...."China's offer is “a sign of weakness, because they're worried.” “Why should we reward them for withdrawing from our own territory, from our own exclusive economic zone? They should not be rewarded,” he said. “Number two, if we don't file according to the deadline, that will diminish our standing in the ITLOS. Because if we're delayed, that means we don't hold enough documents, right? So that might weaken us. It's like an ordinary case. When you ask for a postponement, that means that you lack the materials, and you still need materials,” he added in a mix of English and Filipino. Now, I would like to know who are these officials who want to bite the carrot and withdraw the case so we can publicize who these officials are as they will now be on the list of future collaborators(makapili o traydor) with the bully.

^The Filipino people overwhelmingly support arbitration and the President's approach in general. These appeasers aren't just lousy poker players but insensitive to the will of their constituents.

after snubbing us and intentionally shaming us on a number of occasions? we shove that offer into their lying faces....or rub it in, like in the case of Michael Martinez Malacanang should say that it never received any offer from the PROC or "it got lost in the mail room". just wondering about who that lawmaker/broker is, usual suspect is starts with a "T"? and those spineless cabinet official/s starts with a "B" and maybe "R"? this case MUST push forward with a decision before 2016 just in case the dark lord wins.

Better to stick that carrot up your VP's "where the sun doesn't shine" and feed it to the Chinese government. Their case is weak and they know it.

The sudden generosity to the Philippine "dog" is indicative of this.

Memorial for ITLOS being prepared, says Valte

MANILA - The Philippines will go ahead and file its memorial or written arguments before the International Tribunal for the Law of the Sea (ITLOS) in a bid to bolster its case against China’s sweeping nine-dash claim over the South China Sea (West Philippine Sea).

Now, the memorial is being prepared. We have a deadline; we are ready to meet the deadline and everything to bolster the government’s case, of course, will be contained in the memorial,” deputy presidential spokesperson Abigail Valte.

She said she has no information on reports that China has offered incentives in exchange for not proceeding with the case.

She said the Philippines is ready to argue its case.

Even before the resolution of the dispute, Malacañang said the Philippines has already made a “solid case” before the court of international opinion.

Speaking to ANC's Headstart, Golez said the Philippines should reject any offer of incentive from China because it is disadvantageous to the country.

"Security is priceless. If ever they convert Scarborough Shoal into another military installation the same way they did with Mischief Reef, that is a dagger right in our solar plexus. It is very close to our economic zones, Manila Bay, Subic, even our military bases in the area. They could use that to monitor and interdict us in the future," he said.

"It is also our exclusive economic zone. The marine resources there are also priceless. I think that cannot be compared to all this harassment," he added.

Golez revealed that China had offered incentives in exchange for the Philippines dropping its arbitration case against China before an international tribunal.

He said reliable sources told him that China had offered the Philippines a "mutual withdrawal" from the shoal in exchange for Manila dropping the arbitration.

However, he likened the offer to an "intruder in your own backyard asking the owner that they should both leave."

On Wednesday, a Palace spokesman said the Philippines will go ahead and file its memorial or written arguments before the International Tribunal for the Law of the Sea (ITLOS) in a bid to bolster its case against China’s sweeping nine-dash claim over the South China Sea (West Philippine Sea).

Golez said the filing of the memorial before ITLOS could be a game-changer especially in the Philippine government's initiative to take the rule of law in settling the dispute.

Felt sad about the news of our fishermen being sprayed upon by chinese CG..
Accdng to the reports, there were around 14 PH fishing boats in that area.
I have to presume that they(PH fishing boats) are now regularly fishing on that area but sadly though they NEVER saw any GOVT ship patrolling there.
Cant our CG send one of their Rodham/tenix there at least?
Those bancas being used by our fishermen can last 3-7 days in the middle of the sea, what more of those CG boats.
