BY THE PRESIDENT OF THE PHILIPPINES

ADMINISTRATIVE ORDER NO. 29

NAMING THE WEST PHILIPPINE SEA OF THE REPUBLIC OF THE PHILIPPINES, AND FOR OTHER PURPOSES

WHEREAS, Presidential Decree No. 1599 (1978) established the Exclusive Economic Zone (EEZ) of the Philippines extending to a distance of two hundred nautical miles from the baselines of the Philippine archipelago;

WHEREAS, Republic Act No. 9522 (2009), or the Baselines Law, specifically defined and described the baselines of the Philippine archipelago;

WHEREAS, the Philippines exercises sovereign rights under the principles of international law, including the 1982 United Nations Convention on the Law of the Sea (UNCLOS), to explore and exploit, conserve and manage the natural resources, whether living or non-living, both renewable and non-renewable, of the sea-bed, including the subsoil and the adjacent waters, and to conduct other activities for the economic exploitation and exploration of its maritime domain, such as the production of energy from the water, currents and winds;

WHEREAS, the Philippines exercises sovereign jurisdiction in its EEZ with regard to the establishment and use of artificial islands, installations and structures; marine scientific research; protection and preservation of the marine environment; and other rights and duties provided for in UNCLOS; and

WHEREAS, in the exercise of sovereign jurisdiction, the Philippines has the inherent power and right to designate its maritime areas with appropriate nomenclature for purposes of the national mapping system.

NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the powers vested in me by the Constitution and by law, do hereby order:

Section 1. The maritime areas on the western side of the Philippine archipelago are hereby named as the West Philippine Sea. These areas include the Luzon Sea as well as the waters around, within and adjacent to the Kalayaan Island Group and Bajo De Masinloc, also known as Scarborough Shoal.

Section 2. The naming of the West Philippine Sea is without prejudice to the determination of the maritime domain over territories which the Republic of the Philippines has sovereignty and jurisdiction.

Section 3. The National Mapping and Resource Information Authority (NAMRIA) shall produce and publish charts and maps of the Philippines reflecting the West Philippine Sea in accordance with this Order.

Section 4. The Philippine Government, through the Department of Foreign Affairs (DFA) in consultation with NAMRIA and other appropriate government agencies, shall deposit, at the appropriate time, a copy of this Order enclosing the official map reflecting the West Philippines Sea with the Secretary-General of the United Nations and notify accordingly relevant international organizations, such as the International Hydrographic Organization and the United Nations Conference on the Standardization of Geographical Names.

Section 5. All departments, subdivisions, agencies and instrumentalities of the Government are hereby directed to use and employ the name West Philippine Sea in all communications, messages and public documents, to popularize the use of such name in the general public, both domestically and internationally.

Section 6. All departments, subdivisions, agencies and instrumentalities of the Government are enjoined to use the official Philippine maps produced and published by NAMRIA in accordance with this Order.

For this purpose, the Department of Education (DepEd), the Commission on Higher Education (CHED), and state universities and colleges (SUCs) are directed to issue circulars requiring the use of said official Philippine maps in relevant subjects, researches and instructional materials, such as, among others, text books, instructional materials, and audio-visual presentations.

Section 7. The NAMRIA shall ensure compliance with this Order, pursuant to Department of Environment and Natural Resources Administrative Order (DENR-AO) No. 31 (s. 1988) and other pertinent laws, rules and regulations.

Section 8. The expenditures which may be incurred in the implementation of this Order shall be funded from the existing annual budget of the concerned agencies, subject to the usual accounting and auditing rules and regulations.

Section 9. If any provision of this Order is declared invalid or unconstitutional by competent authority, the other provisions unaffected shall remain valid and subsisting.

Section 10. All issuances, rules and regulations or parts thereof that are inconsistent with the provisions of this Order are hereby revoked, amended, or modified accordingly.

Section 11. This Order shall take effect immediately.

Manila (Philippine Daily Inquirer/ANN) - Concerned about the escalating tensions in the West Philippine Sea (South China Sea), a group of experts on diplomacy and maritime disputes settlement has called on the Aquino administration to establish a more strategic and lasting policy on handling the territorial tug-of-war in the contested waters, citing the region's importance as an economic resource and defence hub for the Philippines and the region.

"There is a need for a comprehensive and strategic approach to policymaking on the WPS, taking into consideration the myriad short- to long-term interests of the country at stake, the fluid regional and international environment, and the domestic imperatives that will affect how government prioritises the allocation of its efforts and resources," read the white paper released this month.

"The West Philippine Sea disputes have had the most impact on our ties with China, the United States and with Southeast Asia. The disputes have led to an undesirable sharp deterioration in our relations with China, an increased need to strengthen defence cooperation with the US, while challenging us to help build a common Asean position," the white paper read.

The group urged government to create a strategic development programme for these resources within the country's Exclusive Economic Zone in the disputed waters, including plans for sustainable fisheries, oil, gas and mineral resources exploration coupled with the necessary law enforcement requirements to protect this sovereign exercise.

Government must also enhance the country's defence capabilities in the western seaboard, citing a "regional defence buildup" that might "spark an arms race that will clearly not be in the Philippines' national interest," the paper said.

"In view of the limited capabilities of both our military and civilian law enforcement agencies, and the need to allocate resources for their upgrading, their respective roles and mandates will need to be clarified," it said.

The Philippines will formally request the official renaming of what has been traditionally known as South China Sea into West Philippine Sea, the Department of Foreign Affairs said Wednesday.

"The President has given an order with regard to the naming of West Philippine Sea of the Republic of the Philippines. The Department of Foreign Affairs will follow his order and will deposit at the appropriate time a copy of the administrative order with the official map reflecting the WPS with the United Nations and other international organizations," said DFA spokesman Raul Hernandez.

The Philippines has taken to calling the disputed waters West Philippine Sea in response to Chinese aggression in the area.

Since last year, Chinese fishing boats—together with Chinese fisheries and maritime ships—have been monitored intruding into Philippine waters, both in the Spratlys (Kalayaan Island Group) off Palawan and the Scarborough Shoal off Zambales.

Chinese aggression in these waters have increased tension among the claimants, including Taiwan, Vietnam, Malaysia, Brunei, and the Philippines. The same Chinese posturing in East China Sea has also strained its relation with Japan

With this renaming of the SCS to WPS and informing the UN officially, two things could happen:

1) The Commies may ignore us for the time being because they are too embroiled with Japan in the Senkaku's.
2) The Commies may vent their anger on us because they could not bully Japan as they can on us.

Wouldn't it be the best opportunity for us to develop the municipality of Kalayaan for tourism by fixing the airport and putting a port now? The bully is busy somewhere else.

AIPEI—Taiwan on Thursday criticized the Philippines for naming South China Sea waters off its west coast the “West Philippine Sea” despite rival sovereignty claims.
Taiwan “does not recognize this unilateral move that will provoke disputes and sternly reaffirms its territorial claim” to the South China Sea, the foreign ministry said in a statement.
“We urge neighboring countries to exercise self-restraint and avoid any unilateral moves that will affect peace and stability in the region, instead replacing confrontation with dialogue,” it said.
Philippine President Benigno Aquino said Wednesday his government would register the new name with the United Nations as part of efforts to delineate its sovereign territory, a move that could further raise tensions with China.

The international community is not likely to accept the Philippines' bid to rename part of the South China Sea as the West Philippine Sea, China claimed Friday.

Chinese Foreign Ministry spokesman Hong Lei said the renaming violated the international standardization of geographic names.

"China has repeatedly urged the Philippines to stop such man-made disputes that complicate the situation in the South China Sea," Hong said, according to an article posted on China's government web portal Saturday.

Earlier this week, President Benigno Aquino III signed an administrative order renaming part of the South China Sea as the West Philippine Sea.

The Philippine government said it will provide the United Nations with a copy of the order and a revised official map of the Philippines.

International community? - maybe. It could be debatable.

China? No surprise there. China doesn't accept anything we or what other countries do. They can go around naming and claiming everything but others can't. This "middle-kingdom" mentality, and their illusion of superiority is as archaic as their history. :headbang:

Try as they might, China becomes the antagonist in this whole scenario, and so, the "international community" BS they say is quite an open mockery.
