"Oh goody, you've said all you want, but we don't get to speak?" Foreign Minister Carsten Huff said, "But enough about that, I'm taking offense at Article II Section A. We're no longer allowed to have secrets? We have to share every single discovery we make with the Communists?!"
Huff shuffled some papers around. "I'm inclined to agree with my counterpart from Kingborough here and stating that Sovreignry might not be partaking in this treaty. And, since we can't claim ownership, there is no justifiable reason for us to actually mine anything. It is prohibitively expensive since we can't sell anything."

It does not say you are to distribute papers without a thought. If you'll look at Article Eleven Section B, you'll note it states you decide what extent and 'feasible' and 'practical'.
"Similarly, not owning the rock doesn't mean you can't tap it's resources because you can't sell it. That's a rather silly notion, frankly. You don't own the waters in your exclusive economic zone, but other states still recognize the resources within that territory as yours. A similar system could be afforded for asteroids. As the Hegemon suggested earlier, we could grant an authority the ability to recognize mining rights, perhaps making the requisite an operating mining facility.
"However, one would still not own the asteroid and be able to do with it as they will."
((OOC: Also, at the present, the Ministry has not drafted forms for mining things, and I do not intend to have operational, super-duper effective, and worthwhile mining facilities prop up across the heavens. Manned missions /might/ be a possibility, but staying there is likely not an option.))

Taeunas will not take part in this socialistic farce. Make it more amenable to a representative and capitalist nation, and maybe we'll consider it." President Smith scowled, his brows bushing together in confusion before he shook it all away. "Facilitate," he returned. "To make easier. To assist. To help bring about. Encourage: to inspire, to support, to stimulate, to attempt to persuade. Additionally, you are taking it out of content, and, frankly, failing at even that."

"I completely fail to see how this demands anything. This demands absolutely nothing. All this does is proclaim a freedom to conduct research in outer space and it's bodies and promote international cooperation. Promote, my fair lady. The terms 'facilitate' and 'encourage' are far from binding; they do not actively mandate action."

"Delegates, leaders, representatives, and hosts. I must say I support the ideals of this treaty, but upon hearing from many of you I also hear your issues and plights with it. It appears many of you are fearful of an organization that will be created that will take away your freedoms that we all seek to have in the heavens. I also understand your fear of sharing information with enemies and potential enemies. Perhaps it is the wording. As many of you have been speaking I've been taking notes and writing revisions to the treaty and here is what I have come up with." He held held out a newly printed and edited version of the treaty. "It is my suggestion that all parties here go ahead and write in their edits to it, by doing so we stop complaining and start working towards a treaty we can all agree to."

States Parties to the Treaty shall recognize and partake in the International Space Agency as the primary international authority on the subjects of outer space and the coordination of outer space activities. 2. The International Space Agency, which shall be based in the Semi-autonomous City of Syntreal City, will be tasks with maintaining an adequate record of all orbital bodies, ensuring that dangerous orbital bodies are removed to the best of its abilities, and aid in facilitation of outer space activities ensuring their compliance with this treaty. 3. The International Space Agency shall be an international organization, under the jurisdiction of no singular government, and manned, in majority though non-exclusively, by Syntaran City nationals.
Article II 1. The exploration and use of outer space, including the moons and all other celestial bodies, shall be carried out for the benefit and in the interests of all countries, regardless of the degree of their economic or scientific development, and shall be the province of all mankind. 2. Outer space, including the moons and all other celestial bodies, shall be free for exploration and use by all States without discrimination, on a basis of equality and in accordance with this Treaty. 3. There shall be freedom of scientific investigation in outer space, including the moons and all other celestial bodies, and States Parties may facilitate and encourage international cooperation in such investigation.
Article III 1. Outer space, including the moons and other celestial bodies, are not subject to claim by nations or corporations, but facilities that are constructed by nations or corporations retain ownership by the nation or corporation that constructed it.
Article IV 1. States Party to the Treaty shall carry on activities in the exploration and use of outer space, including the moons and all other celestial bodies, in accordance with this Treaty in the interest of maintaining a pristine and secure outer space.
Article V 1. Outer space, including the moons and all other celestial bodies, shall be used by all States Parties to the Treaty exclusively for peaceful purposes. 2. States Party to the Treaty pledge not to place in orbit around Oracia any object carrying nuclear weapons or any other kinds of weapons of mass destruction, install such weapons on or in orbit around other celestial bodies, or station such weapons in outer space in any other manner. 3. States Party to the Treaty pledge not to place in orbit around Oracia any object carrying kinetic bombardment weaponry or any other weapons designed, deliberately or coincidentally, for intentional and voluntary assault of the planetary surface, install such weapons on or in orbit around other celestial bodies, or station such objects in outer space in any other manner. 4. The use of military personnel for scientific research or for any other peaceful purpose shall be not prohibited. The use of any equipment or facility necessary for peaceful exploration of the moons and other celestial bodies shall also not be prohibited.
Article VI 1. States Parties to the Treaty shall regard astronauts as envoys of sapient kind in outer space and shall render to them all possible assistance in the event of accident, distress, or emergency landing on the territory of another State Party or the high seas. When astronauts make such a landing, they shall be safely and promptly returned to the State of registry of their space vehicle. 2. In carrying on activities in outer space and on celestial bodies, the astronauts of one State Party shall render all possible assistance to the astronauts of other States Parties. 3. States Parties to the Treaty shall immediately inform the International Space Agency and the other States Party to the Treaty of any phenomena they discover in outer space, including the moons and other celestial bodies, which could constitute a danger to the life or health of astronauts.
Article VII 1. States Parties to the Treaty shall bear international responsibility for national activities in outer space, including the moons and other celestial bodies, whether such activities are carried on by governmental agencies or by non-governmental entities, and for ensuring that national activities are carried out in conformity with the provisions set forth in this Treaty. 2. The activities of non-governmental entities in other space, including the moons and other celestial bodies, shall require authorization and continuing supervision by the appropriate State Party to the Treaty. 3. When activities are carried on in outer space, including the moons and other celestial bodies, by an international organization, responsibility for compliance with this Treaty shall be borne both by the international organization and by the States Parties to the Treaty participating in such organization.
Article VIII 1. Each State Party to the Treaty that launches or procures the launching of an object into outer space, including the moons and other celestial bodies, and each State Party from whose territory or facility an object is launched, is internationally liable for damages to another State Party to the Treaty or its natural or juridical persons by such object or its component parties on Oracia, in air, or in outer space, including the moons and other celestial bodies.
Article IX 1. A State Party to the Treaty on whose registry an object launched into outer space is carried shall retain jurisdiction and control over such object, and over any personal thereof, while in outer space or on a celestial body. 2. Ownership of objects launched into outer space, including objects landed or constructed on a celestial body, and of their component parts, is not affected by their presence in outer space or on a celestial body or by their return to Oracia. 3. Such objects or component parts found beyond the limits of the State Party to the Treaty on whose registry they are carried shall be returned, unaltered, to that State Party, which shall, upon request, furnish identifying data prior to their return.
Article X 1. In the exploration and use of outer space, including the moons and other celestial bodies, State Parties to the Treaty shall be guided by the principle of cooperation and mutual assistance and shall conduct all their activities in outer space, including the moons and other celestial bodies, with due regard to the corresponding interest of all other States Parties to the Treaty. 2. States Parties to the Treaty shall pursue studies of outer space, including the moons and other celestial bodies, and conduct preliminary investigation of them so as to avoid their harmful contamination and also adverse changes in the environment of Oracia resulting from the introduction of extraterrestrial matter and, where necessary, shall adopt appropriate measures for this purpose. 3. If a State Parties to the Treaty has reasons to believe that an activity or experiment planned by it or its nationals in outer space, including the moons and other celestial bodies, would cause potentially harmful interference with activities of other States Parties in the peaceful exploration and use of outer space, including the moons and other celestial bodies, it shall undertake appropriate international consultation before proceeding with any such activities or experiment. 4. A State Party to the Treaty which has reason to believe an activity or experiment planned by another State Party in outer space, including the moons and other celestial bodies, would cause potentially harmful interference with activities in the peaceful use of outer space, including the moons and other celestial bodies, may request consultation concerning the activity or experiment.
Article XI 1. In order to promote international cooperation in the use of outer space, including the moons and other celestial objects, in conformity with the purposes of this Treaty, the States Parties to the Treaty shall consider on a basis of equality any requests by other States Parties to the Treaty to be afforded an opportunity to observe the flight of space objects launched by those States. 2. The nature of such an opportunity for observation and the conditions under which it could be afforded shall be determined by agreement between the States concerned. 3. In order to promote international cooperation in the exploration and use of outer space, States Parties to the Treaty conducting activities in outer space, including the moons and other celestial bodies, agree to inform the International Space Agency as well as the public and the international scientific community, to the greatest extent feasible and practical, of the nature, conduct, locations, and results of such activities. On receiving the said information, the International Space Agency should be prepared to disseminate it immediately and effectively.
Article XII 1. All stations, installations, equipment, and space vehicles in outer space, including the moons and other celestial bodies, shall be open to representatives of the International Space Agency and States Parties to the Treaty on a basis of reciprocity. Such representatives shall give reasonable advance notice of a projected visit, in order that appropriate consultations may be held and that maximum precautions may be taken to assure safety and to avoid interference with normal operations in the facility to be visited.
Article XIII 1. The provisions of this Treaty shall apply to the activities of States Party to the Treaty in the exploration and use of outer space, including the moons and other celestial bodies, whether such activities are carried on by a single State Party to the Treaty or jointly with other States, including cases where they are carried on within the framework of international intergovernmental organizations. 2. Any practical questions arising in connection with activities carried on by international organizations in the exploration and use of outer space, including the moons and other celestial bodies, shall be resolved by the States Parties to the Treaty either with the appropriate international organization or with one of or more States members of that international organization which are Parties to this Treaty.
Article XIV 1. This Treaty shall be open to all States for signature. Any State which does not sign this Treaty before its entry into force in accordance with paragraph C of this article may accede to it at any time. 2. This Treaty shall be subject to ratification by signatory States. Instruments of ratification and instruments of accession shall be deposited with the Governments of the Andresian League and the Noberian Federation, which are hereby designated as Depositary Governments. 3. This Treaty shall enter into force upon the deposit of instrument of ratification by five Governments including the Governments designated as Depositary Governments under this Treaty. 4. For States whose instruments of ratification or accession are deposited subsequent to the entry into force of this Treaty, it shall enter into force on the date of the deposit of their instruments of ratification or accession. 5. The Depositary Governments shall promptly inform all signatory and acceding States of the date of each signature, the date of deposit of each instrument of ratification of and accession to this Treaty, the date of its entry into force, and other notices.
Article XV 1. Any State Party to the Treaty may propose amendments to this Treaty. Amendments shall enter into force for each State Party to the Treaty upon their acceptance by a majority of the States Party to the Treaty.
Article XVI 1. Any State Party to the Treaty may give notice of its withdrawal from the Treaty one year after its entry into force by written notification to the Depositary Governments. Such withdrawal shall take effect one year from the date of receipt of this notification.

Treaty Text THE RESTRICTION OF ARMS IN OUTER SPACE TREATY
The States Parties to this Treaty,
Abhorred by damages brought onto the planet during the Second Great War through the use of nuclear weaponry and orbital kinetic strike systems,
Desiring to protect the planet from similar damages in future conflict,
Believing that outer space should remain neutral in terrestrial wars,
Have agreed on the following:
Article I
- States Party to the Treaty pledge not to place in orbit around Oracia any object carrying nuclear weapons or any other kinds of weapons of mass destruction, install such weapons on or in orbit around other celestial bodies, or station such weapons in outer space in any other manner.

Commander General Arcturus looked over the re-written treaty. In all regards it was a much better version, and it truly was just a treaty without forming any new organization. In all regards it would be acceptable to the Republic, and hopefully to the other delegates.
"So'Karsa will sign this new treaty, it holds to the ideals I feel we all seek to uphold in space. I hope the rest of you will join me in signing this new version of the treaty." when it was time to sign Arcturus would want to be one of the first. this was a historical opportunity for all the nations involved.

Etain smiled slowly at the Chairman. "No, I think not. This does not address many of the other issues. However..." She turned and looked at the gentleman from So'Karsa. "Congradulations, General. You've managed a document that shows me there may be hope for this venture after all. We still do not agree with Article three in its totality, nor section 3 of Article five. Perhaps an exception for asteroids. There needs to be a clause in Article six dealing with nations at war, something about treating them as diplomats rather than a typical prisoner of war, unless they were taken as a result of hostile action." She sat back and steepled her fingers. "We would be willing to work more on that version, if it is amenable to the rest of the delegates."

"The man changed a few word," Friedon Weed chuckled, "and you hail him as a hero?" The President of Assuria raises his eye brows, setting aside the original version, the So'Karsan version. He'd just finished reading the old man's version as well. "I've a few issues, however.
"Firstly, what does 'aid in facilitation' mean, exactly? The third version reduced the ISA to a simple record keeping organization, while the So'Karsan submission expands it's role into apparent interference in operations to... 'ensure compliance with this treaty'. That brings back the question the Kingboroughian asked earlier: 'how will we enforce this?' Will the I.S.A. obtrude the operation?"
Friedon glanced back to the So'Karsan version, glancing at another area he'd circled. "Another issue with his version is that brought back the usage of 'mankind' in Article Two Section One. As the Sylvarians and, again, the Kingboroughian, brought forward: this is unacceptable.
"The usage of the word 'may' in Article Two Section Three, quite frankly, renders it ineffective and pointless. We already may do a lot of things. Might be best to simple scratch that entire sentence out and leave it as 'There shall be freedom of scientific investigation in outer space, including the moons and all other celestial bodies'.
"Furthermore, the modifications to Article Three are quite redundant. Article Nine Section Two clarifies that ownership of objects constructed on celestial bodies does not change simply because it is in outer space, while Section One ordains that jurisdiction and ownership shall belong to the object's State of registry. It's rather awkward working and could use clarification, though I believe it serves our purposes.
"Additionally, I believe diplomats are allowed to leave upon declaration of war. This, coupled with their status as 'envoys', already ensures they are treated as diplomats--returned safely and promptly. I do agree with the President, however, that the astronauts should be detained--or, as you addressed it: taken--if they are armed or otherwise committed 'hostile action'."

"Mr. President you do bring up some good points about my version,which I will concede is not as well written as I would have liked, mostly because I did indeed 'changed a few word' as you said. I will also concede that I prefer the third version because it does reduce the ISA to being a simple record keeping agency,instead of a controlling agency as my own version would have done. Perhaps it would be best for me to list out what So'Karsa would seek, as well as what i believe it is the other delegates are seeking from this treaty." "Taeunas agrees with those save for one. We are fine with a ban on space based WMD's, but others should be allowed. It's too difficult to play catch up if someone who either is not a member of the group, or just plain breaks the treaty, manages to get an orbital based system up and running."

The Belgën delegate Janä Grae just got off the phone with her Empress who was telling her of the documents terms and conditions and the situation. She was speaking on the phone to her Empress, she then passed on her Empress’ answer in her native Belgën and had it translated:

Thus celestial bodies and the contents of said celestial bodies should not be under the ownership of any said nation state, but the public ownership of the ISA to conduct further study, articles such as article six which implies ratification instruments be deposited through and carried out through the Noberian Federation and the Andresian League are of no consequence to us as we are a neutral state.
Article seven leaves room for amendments to be proposed and corrected if any state or states think it is needed through a majority vote of all signatory states. As well as article eight which gives room for any state to withdraw providing they give written documentation to the depositary governments, which will take effect the following year.
My government sees nothing wrong with the rest of the treaty as we do not have any goals to further our national interest into space, nor do we believe it is any right for any one state to monopolise or dictate other states access to space on the basis of political, economic and overall national interests of one or more states. Thus I have the mandate from my Empress to sign if need be.”
