Longish story, so stay with me. I handed my notice in on the property we rent last week. We are leaving at the end of our tenancy and have founds a new place to live. The current agent wanted to arrange a time to take photos. Its difficult for me to get out of work at the moment, but can get home earlyish if needs be, so I offered a late appointment, about 4:30 ish. Not good enough, they need the daylight, fair enough. I asked them to come on a Saturday. No, we dont work saturdays (we viewed this place on a saturday) I offered to take the photos for them and email them across. No its not their policy. I dont want them in the house without me, it can be a bugger to get into and lock up when you leave, unless you know the tricks. I have relented and they are coming tomorrow at 11, I'm not sure I will be here or not, so they can let themselves in. The guy at the agency told me to tidy up, put any clothes and magazines away, make the beds and generaly clean. Cheek, I am pretty bloody tidy I thought, until... ...I get home today and somethings just not right and I cant put my finger on it. Then it hits me, magazines on the coffee table, clothes draped over the dining chairs and on the spare bed and beds unmade!!! I wondered round the house, one of the locks on the front door is unlocked and the biggest thing, the laundry door. We dont use it, so the wash bin and Harrys push chair are propped against it, not now their not. The fecking bastards have been into the house!!!!!!!! :angry: I am beyond furious, they were bullying me into a time and they have fooking been here already!!! The fooking weasel even had the bare faced cheek to lie to me. He told me that they have had a lot of interest from people from the internet ads. I have been to their website, realestate, domain, allhomes and justlisted, not an ad in sight :angry: How do I prove they have been in? Who do I complain to (considering ringing the landlord) Is it worth pursing? If I firebomb their offices, will I be justified? blankers!!!! |

Isn't there a rental authority? I know there is one here as I called it the other day for advice and they govern the real estates as to what they can and can't do. Check your agreement and see what it says on there. |

Call their bluff? Wait in and let them take the pics. If they don't show....and the pics then appear on the advert.... Alternatively - you could call the cops and report someone's entered your premises without authority. |

I dont know if I can be arsed to make a complaint, especially as it will be their word against mine. I just want to catch the little bastard out!! I am going to ring the manager in the morning. I am under no obligation to let them in to take photos and dont appreciate being bullied by the little twerp, so I will go into one. I want to make them squirm. And give me a clean bill of health on final inspection :D |

Yeah, done that. They have all been out all day so havent seen anything :no: The lady who lives behind us was really annoyed on our behalf, so I have a feeling she will become a curtain twitcher until we leave :thumbsup: |

The QLD rental regs are that they have to give you 24 hours written notice before they can let thereselves in. Trespassing otherwise, |

And even then it has to be with your permission, otherwise it's still trespassing. They can take you to court for breach of agreement (if the tenancy agreement allows them access under reasonable circumstances) but they still can't just enter, especially when no-one is home. Call the cops and report a break and enter, AB. |

Well I confronted them this morning and they owned up to it. The guys excuse was that he thought the property was vacant!! :dunno: He entered the house through the back, there are toys in the garden and washing on the line, he would have been able to see into the house and would have noticed furniture!! Obvious signs of life to me!! I laid it on thick, told him I have a small child, and when I noticed the house had been entered I told him I cleared out as I was afraid for my son :D He maintains it was an accident, but I reckon its pure bullshit, they have the house on their books, they fooking well know the lease has not yet expired and we havent moved out!!! I will remember this come bond time, and if they try to stiff me for any money, I will report them to the Office of Fair Trading. I called them this morning and they said it was bang out of order and I am within my rights to make a complaint. |

Try getting it in writing (though I know that's going to be tricky). Maybe send them an email saying that you're complaining about them entering your property unauthorised etc etc. If they reply - then at least you'll have it in writing and when it comes to bond return then you've got a bit of extra leverage. |
